Dear Arizona Voters: The year 2002 is a major election year in Arizona. By voting in the primary and general elections this fall, you will be electing candidates for the 9 statewide offices, including the Governor, Secretary of State, Attorney General, Treasurer, Superintendent of Public Instruction, Corporation Commissioner and Mine Inspector. You will also be electing candidates for the 90 legislative offices; 30 Senators and 60 Representatives. This Candidate Statements pamphlet is a nonpartisan, plain-language handbook published by the Citizens Clean Elections Commission, an independent state agency, to give you information about State elections. The Commission's mission is to fairly, faithfully and fully implement and administer Arizona's Citizens Clean Elections Act, which is a campaign finance reform measure initiated by Arizona citizens and passed by voters in 1998. The Act creates a new campaign financing system that provides full public funding to qualified state and legislative office candidates who agree to abide by the Citizens Clean Elections Act and Commission regulations. Through the successful implementation of the Citizens Clean Elections Act, the Commission seeks to promote public confidence in the electoral process. One pamphlet has been mailed to each household in Arizona that contains a registered voter prior to the Primary Election, and prior to the General Election. The Secretary of State will mail the Publicity Pamphlet that contains the Ballot Propositions and Judicial Performance Reviews prior to the General Election. The candidates are listed in alphabetical order by last name for the office sought. The candidate statements contained in this pamphlet have been reprinted as supplied by the candidates. Key To Using the Candidate Statements Pamphlet
The following is a description of terms used within the Candidate Statement pamphlet. CCEC: Citizens Clean Elections Commission acronym Citizens Clean Elections Commission (CCEC): The state agency created to oversee the Citizens Clean Elections Act. Citizens Clean Elections Act: A campaign finance reform measure initiated by Arizona citizens and passed by voters in 1998. The Act creates a new campaign finance system that provides full public funding to qualified statewide and legislative candidates who agree to abide by strict spending and contribution limits. Legislative Offices: Senate and House of Representatives. Nonparticipating Candidate: An Arizona statewide or legislative candidate who is running for office the traditional way, by raising private funds. Participating Candidate: An Arizona statewide or legislative candidate who has qualified for and is running for office using Clean Elections (public) funding. Statewide Offices: Governor, Secretary of State, Attorney General, Treasurer, Superintendent of Public Instruction, Corporation Commissioner, and Mine Inspector.

Arizona's Citizens Clean Elections Act
The Citizens Clean Elections Act, which was passed by voters in the November 1998 General Election, fundamentally changed Arizona's campaign finance laws by establishing a system for publicly funding candidate campaigns. The system is voluntary; candidates may choose to participate to receive public funding or they may choose to raise private campaign funds. The Governor proclaimed the Act as law on December 10, 1998. On February 16, 1999, the United States Department of Justice precleared the Act, thereby allowing the Act to go into effect. Then, the Citizens Clean Elections Commission was formed. The following are highlights of the Act: I. II. The Act applies to candidates for legislative and statewide offices. To participate in the public funding system, a candidate must raise a number of $5 qualifying contributions during a defined qualifying period. Contributions may only be made by qualified electors in the candidate's district. Furthermore, contributions from corporations and political action committees are prohibited. a. For statewide office, the qualifying period runs from August 1 of the year before the election until 75 days before the general election. b. For legislative office, the qualifying period runs from January 1 of the election year until 75 days before the general election. c. The minimum number of $5 qualifying contributions candidates must obtain during the qualifying period are as follows: Legislature Mine Inspector Corporation Commissioner Superintendent of Public Instruction Treasurer Attorney General Secretary of State Governor III. The person soliciting $5 qualifying contributions for a candidate cannot be compensated by the candidate to collect the contributions. Participating candidates must complete the following provisions in order to qualify for funding:

The candidate also must file a list of the persons making qualifying contributions and give the Secretary of State a check for the total amount of the $5 qualifying contributions received, as well as the original signed contributor slips. V. There are set amounts of public funding for participating candidates. The base amounts are established in statute and adjusted for inflation every two years by the Secretary of State. a. Candidates who qualify for funding in contested party primary elections may receive an amount equal to the original primary election spending limit. c. An independent candidate is eligible to receive 70 percent of the sum of the original primary and general election spending limits. d. In the 2002 election, participating legislative candidates may use $530 of personal monies for their campaigns; candidates for statewide office may use $1,060 of personal monies for their campaigns. f. Participating candidates may raise a limited number of private contributions, which are called early contributions, during the exploratory and qualifying periods. The early contributions are limited to $110 per individual contributor. The base amounts are established in statute and adjusted for inflation every two years by the Secretary of State. Participating candidates having debt from a prior election in which they were not publicly funded may accept contributions to retire that debt, subject to the nonparticipating candidate limits and only during the exploratory period. Nonparticipating candidate contribution limits are lowered by 20 percent. Participating candidates are entitled to receive matching funds when an opposing, nonparticipating candidate exceeds the primary or general election spending limits. Matching funds also will be provided to participating candidates when independent expenditures are made on behalf of a nonparticipating or other participating candidate in the race. There are additional campaign finance reporting requirements. a. In addition to existing campaign finance reports that all candidates must file, nonparticipating candidates must file "original" and "supplemental" campaign finance reports with the Secretary of State when the candidates make expenditures that exceed 70 percent of the primary election spending limit, or receive contributions, less the expenditures through the primary, that exceed 70 percent of the general election spending limit. b. In addition to existing campaign finance reports that all candidates must file, participating candidates must file recap reports at the end of the qualifying, primary and general election periods.

Campaign finance reports must be filed electronically with the Secretary of State, and bank accounts, campaign finance reports and financial records relating to the campaign must be available for public inspection. Any individual or entity making an independent expenditure on behalf of a candidate must report the expenditure once it exceeds $530 in an election cycle. Each additional independent expenditure totaling $1,000 must be reported as well. There are potential legal consequences for enforcement actions. a. Civil penalties

i. A participating candidate who exceeds the contribution or expenditure limits, shall be assessed a penalty of ten times the excess contribution or expenditure. ii. Any candidate that violates the reporting requirements shall be assessed a penalty of $110 per day for legislative candidates and $320 per day for statewide candidates. iii. Under some circumstances, the candidate may be disqualified or forced to forfeit office. iv. A known violation by a participating candidate will require the candidate to repay from personal funds all monies expended from the candidate campaign account. b. XI. The Citizens Clean Elections Commission
The Citizens Clean Elections Commission was established by the enactment of the Citizens Clean Elections Act, A.R.S., Title 16, Chapter 6, Article 2. In addition to enforcing the provisions of Article 2, the Commission promulgates rules and enforces A.R.S. �� 16-940 through 16-961. The Commission consists of 5 members: � � � No more than 2 shall be members of the same political party. No more than 2 shall be residents of the same county. No one shall be appointed who does not have a party registration that has been continuously recorded for at least 5 years immediately preceding appointment, with the same political party or as an independent. Each candidate shall be a qualified elector who has not, in the previous 5 years in this state, been appointed to, elected to or run for any public office, including precinct committeeman, or served as an officer of a political party. A member of the Commission shall serve no more than one term and is not eligible for reappointment. No Commissioner, during his or her tenure or for 3 years thereafter, shall seek or hold any other public office, serve as an officer of any political committee or employ or be employed as a lobbyist.

The Commissioners are chosen based upon the following criteria: � � Those who are committed to enforcing the Act in an honest, independent and impartial fashion. Those who seek to uphold public confidence in the integrity of the electoral system.
Initially, the Commission on Appellate Court Appointments nominated 5 slates each having 3 candidates. Beginning in the year 2000, the Governor and the highest-ranking official holding a statewide office who is not a member of the same political party as the Governor alternate filling such vacancies. � Governor Jane Dee Hull (R) selected a candidate, L. The Citizens Clean Elections Fund receives its revenues from the following sources: � An additional surcharge of 10 percent imposed on all civil and criminal fines and penalties collected pursuant to A.R.S. � 12-116.01. � A $5 voluntary contribution per taxpayer who files an Arizona state income tax return and marks an optional check-off box on the first page of the form. A taxpayer who checks this box receives a $5 reduction in tax liability and $5 goes to the Clean Elections Fund. � A voluntary donation to the Fund by designating the Fund on an income tax return form filed by the individual or business entity, or by making a payment directly to the Fund. Any taxpayer making a donation shall receive a dollar-fordollar tax credit not to exceed 20 percent of the tax amount on the return or $530 per taxpayer, whichever is higher. � � Act. Tax Credits
Receive a $5 Tax Reduction Arizona taxpayers can reduce their state tax amount by $5 by marking the box entitled, "Clean Elections Fund Tax Reduction" on the first page of their Arizona income tax return form. If you are married and filing jointly, you will receive a reduction of $10. A taxpayer must have a tax amount of at least $5 in order to qualify for the reduction. For each marked box, the State also will add $5 to the Clean Elections Fund. Receive a Dollar-for-Dollar Tax Credit An Arizona taxpayer can obtain a tax credit by making a payment directly to the Clean Elections. A donation to the Clean Elections Fund entitles any taxpayer to a dollar-fordollar tax credit; not to exceed 20% of the tax amount on the income tax return or $530 per taxpayer whichever is greater. These voluntary donations cannot be designated to benefit a particular candidate, political party or election, and are applicable only on State taxes. Make checks payable to: Citizens Clean Elections Fund, 4001 N. 3rd Street, Suite 200, Phoenix, AZ 85012. Any taxpayer can also designate that all or part of an expected refund go to the Clean Elections Fund by filling in the amount of the refund in the Citizens Clean Elections Fund voluntary gift box at the bottom of the front page of the tax form. Debate Information
The Citizens Clean Elections Commission will sponsor a series of debates prior to the Primary and General elections for statewide and legislative office candidates. Participating candidates are required to attend the debates. Nonparticipating candidates will be invited and are encouraged to participate in the Commission-sponsored debates. Candidates invited to participate in the debates will be limited to those candidates who will appear on the Primary or General Election ballots. All candidates must appear in person, not by proxy or electronically, unless to accommodate a disability. The Commission has contracted with organizations to co-sponsor the debates. The co-sponsors were chosen based upon their experience, resources and perception of nonpartisanship. Description of Offices Statewide Offices Governor
The Governor is the state's Chief Executive Officer. The Governor transacts most executive business with state government officers. The Governor convenes the legislature in sessions, communicates to the legislature at every session the condition of the state, and makes recommendations as needed. The Governor is commander-inchief of the State National Guard. By voting in the primary and general elections this fall, you will be electing candidates for the 9 statewide offices, including the Governor, Secretary of State, Attorney General, Treasurer, Superintendent of Public Instruction, Corporation Commissioner and Mine Inspector. You will also be electing candidates for the 90 legislative offices; 30 Senators and 60 Representatives. This Candidate Statements pamphlet is a nonpartisan, plain-language handbook published by the Citizens Clean Elections Commission, an independent state agency, to give you information about State elections. The Commission's mission is to fairly, faithfully and fully implement and administer Arizona's Citizens Clean Elections Act, which is a campaign finance reform measure initiated by Arizona citizens and passed by voters in 1998. The Act creates a new campaign financing system that provides full public funding to qualified state and legislative office candidates who agree to abide by the Citizens Clean Elections Act and Commission regulations. Through the successful implementation of the Citizens Clean Elections Act, the Commission seeks to promote public confidence in the electoral process. CCEC: Citizens Clean Elections Commission acronym Citizens Clean Elections Commission (CCEC): The state agency created to oversee the Citizens Clean Elections Act. Citizens Clean Elections Act: A campaign finance reform measure initiated by Arizona citizens and passed by voters in 1998. The Act creates a new campaign finance system that provides full public funding to qualified statewide and legislative candidates who agree to abide by strict spending and contribution limits. Legislative Offices: Senate and House of Representatives. Nonparticipating Candidate: An Arizona statewide or legislative candidate who is running for office the traditional way, by raising private funds. Participating Candidate: An Arizona statewide or legislative candidate who has qualified for and is running for office using Clean Elections (public) funding. Statewide Offices: Governor, Secretary of State, Attorney General, Treasurer, Superintendent of Public Instruction, Corporation Commissioner, and Mine Inspector. Statements reprinted, including spelling, grammar, and punctuation, as supplied by the candidates. 7 2002 Statewide and Legislative Candidate Statements Arizona's Citizens Clean Elections Act The Citizens Clean Elections Act, which was passed by voters in the November 1998 General Election, fundamentally changed Arizona's campaign finance laws by establishing a system for publicly funding candidate campaigns. The system is voluntary; candidates may choose to participate to receive public funding or they may choose to raise private campaign funds. The Governor proclaimed the Act as law on December 10, 1998. On February 16, 1999, the United States Department of Justice precleared the Act, thereby allowing the Act to go into effect. Then, the Citizens Clean Elections Commission was formed. The following are highlights of the Act: I. II. The Act applies to candidates for legislative and statewide offices. To participate in the public funding system, a candidate must raise a number of $5 qualifying contributions during a defined qualifying period. Contributions may only be made by qualified electors in the candidate's district. Furthermore, contributions from corporations and political action committees are prohibited. a. For statewide office, the qualifying period runs from August 1 of the year before the election until 75 days before the general election. b. For legislative office, the qualifying period runs from January 1 of the election year until 75 days before the general election. c. Participating candidates may raise a limited number of private contributions, which are called early contributions, during the exploratory and qualifying periods. The early contributions are limited to $110 per individual contributor. The base amounts are established in statute and adjusted for inflation every two years by the Secretary of State. Participating candidates are entitled to receive matching funds when an opposing, nonparticipating candidate exceeds the primary or general election spending limits. Matching funds also will be provided to participating candidates when independent expenditures are made on behalf of a nonparticipating or other participating candidate in the race. There are additional campaign finance reporting requirements. a. In addition to existing campaign finance reports that all candidates must file, nonparticipating candidates must file "original" and "supplemental" campaign finance reports with the Secretary of State when the candidates make expenditures that exceed 70 percent of the primary election spending limit, or receive contributions, less the expenditures through the primary, that exceed 70 percent of the general election spending limit. b. In addition to existing campaign finance reports that all candidates must file, participating candidates must file recap reports at the end of the qualifying, primary and general election periods. Campaign finance reports must be filed electronically with the Secretary of State, and bank accounts, campaign finance reports and financial records relating to the campaign must be available for public inspection. Any individual or entity making an independent expenditure on behalf of a candidate must report the expenditure once it exceeds $530 in an election cycle. Each additional independent expenditure totaling $1,000 must be reported as well. There are potential legal consequences for enforcement actions. a. Civil penalties d. IX. i. A participating candidate who exceeds the contribution or expenditure limits, shall be assessed a penalty of ten times the excess contribution or expenditure. ii. Any candidate that violates the reporting requirements shall be assessed a penalty of $110 per day for legislative candidates and $320 per day for statewide candidates. iii. Under some circumstances, the candidate may be disqualified or forced to forfeit office. iv. A known violation by a participating candidate will require the candidate to repay from personal funds all monies expended from the candidate campaign account. b. XI. Known violations are prosecutable as a Class One Misdemeanor. Citizens Clean The Act establishes a 5-member Commission, the Elections Commission, to implement and enforce the Act. In addition to enforcing the provisions of Article 2, the Commission promulgates rules and enforces A.R.S. �� 16-940 through 16-961. The Commission consists of 5 members: � � � No more than 2 shall be members of the same political party. No more than 2 shall be residents of the same county. No one shall be appointed who does not have a party registration that has been continuously recorded for at least 5 years immediately preceding appointment, with the same political party or as an independent. Each candidate shall be a qualified elector who has not, in the previous 5 years in this state, been appointed to, elected to or run for any public office, including precinct committeeman, or served as an officer of a political party. A member of the Commission shall serve no more than one term and is not eligible for reappointment. No Commissioner, during his or her tenure or for 3 years thereafter, shall seek or hold any other public office, serve as an officer of any political committee or employ or be employed as a lobbyist. � � � The Commissioners are chosen based upon the following criteria: � � Those who are committed to enforcing the Act in an honest, independent and impartial fashion. Those who seek to uphold public confidence in the integrity of the electoral system. Initially, the Commission on Appellate Court Appointments nominated 5 slates each having 3 candidates. If you are married and filing jointly, you will receive a reduction of $10. A taxpayer must have a tax amount of at least $5 in order to qualify for the reduction. For each marked box, the State also will add $5 to the Clean Elections Fund. Receive a Dollar-for-Dollar Tax Credit An Arizona taxpayer can obtain a tax credit by making a payment directly to the Clean Elections. A donation to the Clean Elections Fund entitles any taxpayer to a dollar-fordollar tax credit; not to exceed 20% of the tax amount on the income tax return or $530 per taxpayer whichever is greater. These voluntary donations cannot be designated to benefit a particular candidate, political party or election, and are applicable only on State taxes. The Governor transacts most executive business with state government officers. The Governor convenes the legislature in sessions, communicates to the legislature at every session the condition of the state, and makes recommendations as needed. The Governor is commander-inchief of the State National Guard. Additionally, the Governor has the authority to appoint state Supreme Court justices and judges for the state Court of Appeals and trial courts. The term for Governor is 4 years, and voters may vote for 1 candidate in the Primary and General Elections. Secretary of State The Secretary of State is the Chief Election Officer for the state whose duties include certifying candidates and election results. The Secretary of State serves as Acting Governor when the Governor is out of the state. The Secretary of State is the official keeper of records. Duties include filing the administrative rules of the state agencies and maintaining the official rules of the state agencies adopted under the Arizona Administrative Procedure Act. Additionally, the Secretary of State registers trade names and trademarks, and issues certificates of registration. The Secretary of State is first in the constitutional line of succession if the Governor leaves office in mid-term. The term for Secretary of State is 4 years, and voters may vote for 1 candidate in the Primary and General Elections. Attorney General The Attorney General is the chief legal officer in Arizona. The Attorney General's duties include serving as legal advisor for most state agencies, bringing and defending law suits on behalf of the State, enforcing criminal, election, environmental, civil rights, and consumer protection laws, and serving as Director of the Department of Law. The Attorney General also issues formal legal opinions for State officers, legislators, and county attorneys upon request. The Attorney General is second in the constitutional line of succession if the Governor leaves office in mid-term. Treasurer The Treasurer is the State's chief financial officer and is the keeper of the state's monies. Superintendent of Public Instruction The Superintendent of Public Instruction superintends the public elementary and high school system. The Superintendent serves on the Board of Education, which sets policy for the school systems of Arizona. The Superintendent oversees the Department of Education that executes the policies chosen by the board. The Superintendent of Public Instruction is fourth in the constitutional line of succession if the Governor leaves office in mid-term. The term for Superintendent of Public Instruction is 4 years, and voters may vote for 1 candidate in the Primary and General Elections. Corporation Commission The Corporation Commission regulates rates charged by gas, water, sewer, electric and telephone utilities; regulates issuance and enforcement of securities, and regulates formation and filings by all corporations doing business in Arizona. The term for Corporation Commissioner is 4 years. After the 2002 election, there will be five corporation commissioners. Three Corporation Commissioners will be elected in 2002. In order to facilitate staggered terms of service, one will serve a four-year term and two others will serve two-year terms this cycle only. Voters may vote a five-year term and two candidates for the two-year term. Mine Inspector The Mine Inspector enforces the State Mining Code and provides training and conducts investigations to improve individual health and safety. The Mine Inspector's duties also include providing worksite evaluations, inspections, reviews and monitoring all mine reclamation activities.
