Tribal Consultation Report
January 1, 2006 through December 31, 2006
This report is prepared and submitted by the Arizona Department of Economic Security, pursuant to Arizona Executive Order 2006-14. The report provides a summary of the opportunities for coordination and consultation which occurred between the Arizona Department of Economic Security and the various Arizona Indian Tribes during 2006.
Ak-Chin Indian Community
Topic for Consultation Indian Child Welfare Act of 1978 (ICWA), Native American Foster/Adoptive Families Recruitment Plan, Title IV-B State Plan and Intergovernmental Agreements. Colorado River Indian Tribes
Topic for Consultation Intergovernmental Agreement for Title XIX (Medicaid) case management on reservation. Time Frame of Consultation Summer of 2006. Brief Description The tribe inquired about the feasibility of an Intergovernmental Agreement for Title XIX case management services for individuals with developmental disabilities on the reservation. After research, the tribe concluded that it would not be cost effective. The number of consumers is low on the reservation. The meetings ensure that ICWA compliance measures and policy development and implementation foster best practice, sharing and securing needed resources, and providing internal/external training and cross training. Outcome Closed due to the low caseload.

Hopi Indian Tribe

Brief Description The Hopi Tribe operates its own TANF program, which was approved in 2001. The tribe contracts with DES to perform eligibility determination using Department staff and the Department's automated eligibility system. The Department meets quarterly with the Hopi Tribe in order to ensure that the work being done by the Department is consistent with the Hopi program guidelines. Navajo Nation
Topic for Consultation Arizona Early Intervention Program (AzEIP). Time Frame of Consultation Throughout 2006. Brief Description The Department provided the Navajo Nation with an opportunity to provide public comment in the following areas related to the AzEIP program: � Early intervention policy; and � Planning events relating to planning and design (redesign) of Arizona's early intervention practices. The Department also provides training and technical assistance opportunities in early intervention practices to the Navajo Nation. Because DES/AzEIP directly contracts with the Navajo Nation, training and technical assistance has been specifically tailored to the Navajo Nation. Temporary Assistance to Needy Families (TANF) program coordination. Coordination of child support enforcement services provided the Department. Technical assistance and issue resolution related to Title XIX (Medicaid). Quarterly meetings in 2006. The quarterly meetings focus on issues of clients who may be in both tribal-administered programs and DES-administered programs. The Department continues to participate in the quarterly meetings and coordinate service delivery with the Navajo Nation TANF program representatives. Consultation continued throughout 2007 and continues into 2007. Outcome The Department continues to provide the Navajo Nation with the opportunity to contribute, comment, and/or participate in public comment opportunities, training and technical assistance events, presentations, and planning opportunities relating to policy and/or practice.
Ongoing since August 2006.
The Department and the Navajo Nation have entered into an Intergovernmental Agreement to provide child support enforcement services to the Navajo Nation. The Department and the Navajo Nation coordinate on issues related to Title XIX. The Department provides assistance with programmatic questions that require technical assistance. The Department offers ongoing training on program changes and updates as needed.
The consultation was ongoing throughout 2006, with an average of two to three contacts per week.

Navajo Nation (continued)
Topic for Consultation Land use permit for a new modular building. Time Frame of Consultation The consultation for land occurred from June 2006 through September 2006. Brief Description The DES requested a land use permit through the Kayenta Township for placing a new modular office building in Kayenta, Arizona. Option one: A new location was identified for use on the west side of Kayenta, but there was no electrical, water, or sewer service. Option two: Continue leasing the existing locations. Option two was chosen due to financial cost of establishing water, electrical, and sewer services at the proposed new site. Intergovernmental Agreement (IGA) process streamlining. Initial meeting on October 13, 2006. A meeting was held between the Navajo Nation and the DES Office of Procurement to begin research into streamlining the IGA process between the Navajo Nation and DES. The Navajo Nation mentioned the possibility of consolidating some basic clauses that could be used throughout DES and, in turn, other state agencies. The DES Office of Procurement staff contacted other tribal state agency liaisons to determine if there was an interest in participating in a work group to research and continue working on basic contract clauses that could be used with all tribal IGAs. The response was positive. The liaisons forwarded the information to their contracting staff, and approximately six different state agencies had contact or liaison staff who demonstrated a high level of interest in participating. Consultation with the individual agency contract and tribal liaison staff is continuing on through 2007. Outcome The DES placed a new modular office building on the existing Kayenta site after receiving approval from the Kayenta Township.

The Salt River Pima-Maricopa Indian Community
Topic for Consultation Temporary Assistance to Needy Families (TANF) eligibility. Time Frame of Consultation Quarterly meetings in 2006. Brief Description The Salt River Pima-Maricopa Indian Community operates its own TANF program, which was approved in 1999. Salt River staff use the Department's automated eligibility system to conduct their TANF program eligibility determinations. The Department meets quarterly with the Salt River Pima-Maricopa Indian Community in order to ensure that the Department's automated eligibility system is addressing the Salt River Pima-Maricopa program needs. Temporary Assistance to Needy Families (TANF) overpayments. January 18, 2006, May 6, 2006, and May 17, 2006. The Department, through an Intergovernmental Agreement, conducts TANF overpayment recoveries. The Department and the Salt River Pima-Maricopa Indian Community staff meet to coordinate and streamline the referral and follow-up process for this collection activity. Tohono O'odham Nation
Topic for Consultation Adult Protective Services (APS) training. Time Frame of Consultation October 30, 2006, to present. Brief Description The Tohono O'odham Nation requested assistance in training their new Adult Protective Services worker hired under the Bureau of Indian Affairs Adult Care program. They requested "shadowing" and other training support by the Department's Tucson APS staff. Outcome Department APS staff met with the new Tohono O'odham Nation APS worker and provided available training resources, case processes, confidentiality, and Health Insurance Portability and Accountability Act (HIPAA) information. The Department also provided sample forms the Department uses. As requested, the Tohono O'odham APS worker has "shadowed" Department staff as an observer. The training and consultation will continue as requested by the Nation. White Mountain Apache Tribe

Brief Description The White Mountain Apache Tribe operates its own TANF program, which was approved in 1998. The tribe contracts with DES to perform eligibility determination using Department staff and the Department's automated eligibility system. The Department meets quarterly with the White Mountain Apache Tribe in order to ensure that the work being done by the Department is consistent with the White Mountain Apache program guidelines. The Department was asked to cover the costs for room and board for some developmentally disabled White Mountain Apache Tribal members living outside their home. Outcome Consultation with the White Mountain Apache TANF program staff is ongoing.
Payment of room and board for developmentally disabled persons.
Summer of 2006.
The Department assumed the cost of room and board for nine Tribal members residing at Valley of the Sun effective July 1, 2006. The Bureau of Indian Affairs has agreed to continue funding additional requests from Tribal members through State Fiscal Year 2007.

Wareing Director Arizona Department of Economic Security Tribal Consultation Report January 1, 2006 through December 31, 2006 This report is prepared and submitted by the Arizona Department of Economic Security, pursuant to Arizona Executive Order 2006-14. The report provides a summary of the opportunities for coordination and consultation which occurred between the Arizona Department of Economic Security and the various Arizona Indian Tribes during 2006. Ak-Chin Indian Community Topic for Consultation Indian Child Welfare Act of 1978 (ICWA), Native American Foster/Adoptive Families Recruitment Plan, Title IV-B State Plan and Intergovernmental Agreements. Brief Description The tribe inquired about the feasibility of an Intergovernmental Agreement for Title XIX case management services for individuals with developmental disabilities on the reservation. After research, the tribe concluded that it would not be cost effective. The number of consumers is low on the reservation. Time Frame of Consultation Throughout 2006. Brief Description The Department provided the Navajo Nation with an opportunity to provide public comment in the following areas related to the AzEIP program: � Early intervention policy; and � Planning events relating to planning and design (redesign) of Arizona's early intervention practices. The Department also provides training and technical assistance opportunities in early intervention practices to the Navajo Nation. Because DES/AzEIP directly contracts with the Navajo Nation, training and technical assistance has been specifically tailored to the Navajo Nation. Temporary Assistance to Needy Families (TANF) program coordination. Coordination of child support enforcement services provided the Department. Technical assistance and issue resolution related to Title XIX (Medicaid). Quarterly meetings in 2006. The quarterly meetings focus on issues of clients who may be in both tribal-administered programs and DES-administered programs. The Department continues to participate in the quarterly meetings and coordinate service delivery with the Navajo Nation TANF program representatives. Consultation continued throughout 2007 and continues into 2007. Outcome The Department continues to provide the Navajo Nation with the opportunity to contribute, comment, and/or participate in public comment opportunities, training and technical assistance events, presentations, and planning opportunities relating to policy and/or practice. Ongoing since August 2006. The Department and the Navajo Nation have entered into an Intergovernmental Agreement to provide child support enforcement services to the Navajo Nation. The Department and the Navajo Nation coordinate on issues related to Title XIX. The Department provides assistance with programmatic questions that require technical assistance. The Department offers ongoing training on program changes and updates as needed. The consultation was ongoing throughout 2006, with an average of two to three contacts per week. The consultation is ongoing. 9 Navajo Nation (continued) Topic for Consultation Land use permit for a new modular building. Time Frame of Consultation The consultation for land occurred from June 2006 through September 2006. Brief Description The DES requested a land use permit through the Kayenta Township for placing a new modular office building in Kayenta, Arizona. Option one: A new location was identified for use on the west side of Kayenta, but there was no electrical, water, or sewer service. Option two: Continue leasing the existing locations. Option two was chosen due to financial cost of establishing water, electrical, and sewer services at the proposed new site. Intergovernmental Agreement (IGA) process streamlining. Initial meeting on October 13, 2006. A meeting was held between the Navajo Nation and the DES Office of Procurement to begin research into streamlining the IGA process between the Navajo Nation and DES. The Navajo Nation mentioned the possibility of consolidating some basic clauses that could be used throughout DES and, in turn, other state agencies. The DES Office of Procurement staff contacted other tribal state agency liaisons to determine if there was an interest in participating in a work group to research and continue working on basic contract clauses that could be used with all tribal IGAs. The response was positive. The liaisons forwarded the information to their contracting staff, and approximately six different state agencies had contact or liaison staff who demonstrated a high level of interest in participating. Consultation with the individual agency contract and tribal liaison staff is continuing on through 2007. Outcome The DES placed a new modular office building on the existing Kayenta site after receiving approval from the Kayenta Township. 10 Navajo Nation (continued) Topic for Consultation Indian Child Welfare Act of 1978 (ICWA), Native American Foster/Adoptive Families Recruitment Plan, Title IV-E foster care maintenance payments, Title IV-B State Plan and Intergovernmental Agreements. Salt River staff use the Department's automated eligibility system to conduct their TANF program eligibility determinations. The Department meets quarterly with the Salt River Pima-Maricopa Indian Community in order to ensure that the Department's automated eligibility system is addressing the Salt River Pima-Maricopa program needs. Temporary Assistance to Needy Families (TANF) overpayments. January 18, 2006, May 6, 2006, and May 17, 2006. The Department, through an Intergovernmental Agreement, conducts TANF overpayment recoveries. The Department and the Salt River Pima-Maricopa Indian Community staff meet to coordinate and streamline the referral and follow-up process for this collection activity. Brief Description The Tohono O'odham Nation requested assistance in training their new Adult Protective Services worker hired under the Bureau of Indian Affairs Adult Care program. They requested "shadowing" and other training support by the Department's Tucson APS staff. Outcome Department APS staff met with the new Tohono O'odham Nation APS worker and provided available training resources, case processes, confidentiality, and Health Insurance Portability and Accountability Act (HIPAA) information. The Department also provided sample forms the Department uses. As requested, the Tohono O'odham APS worker has "shadowed" Department staff as an observer. The training and consultation will continue as requested by the Nation. The Department meets quarterly with the White Mountain Apache Tribe in order to ensure that the work being done by the Department is consistent with the White Mountain Apache program guidelines. The Department was asked to cover the costs for room and board for some developmentally disabled White Mountain Apache Tribal members living outside their home.
