DESCRIPTION	Opinion No. 65-1 (R-45). 12 pages (PDF version) file size: 456.13 KB. Letter to R.F. Castro, Assistant Superintendent, Motor Vehicle Division, stating that in light of the decision of Visco, et al. (Ariz. Mill Supply Co.) v. State ex rel. Pickrell, et al., 95 Ariz. 154, 388 P.2d 155, the provisions of Ariz. Rev. Stat. §40-641, which deals with licenses for common carriers, do not apply to garbage haulers because this group is not affected with the public interest as to require police power regulation. The opinion advises that a group of garbage haulers might be exposed to the provisions of Ariz. Rev. Stat. §40-641, if they were contracted specifically to haul refuse or if the garbage was toxic. The opinion concludes by saying that taxes that garbage haulers were to pay before the Visco decision were free of that obligation, but any taxes paid before the decision were not refundable unless the tax was paid under protest.
