Dear Mr. President:
The Maricopa County CPS Protocol Committee on Training and Compliance hereby provides the
Annual Report of Activities of Agency participants in the Protocol as required by statute. Beginning
July 2008, the Committee requested that agencies provide detailed information required for this year's
Report [ Committee request located in Appendix]. Reporting activity is summarized topically by selfreported
activity for Law Enforcement, CPS and Prosecution. The remainder of the report is tabbed by
individual agency outlining their reporting activity by ARS code.
This year the Maricopa County Attorney identified stronger reporting patterns than in year's past;
however, compliance with report is still not universal. For instance, agencies often report using their
own format making comparisons and analysis difficult.
We are nearly finished with the 5- year revision of the entire Protocol. This year the full
Multidisciplinary team met several times to revisit and update all aspects of the full Protocol. This
included areas covered by the Statutes as well as the original Multidisciplinary team product. The
Committee is optimistic that as a result, the reporting process will be strengthened. We envision
delivering a fully revised Protocol to you by October 2008.

EXECUTIVE SUMMARY
Training Background
The Multi- Disciplinary Investigations ofChild Abuse Protocols outlines the following
courses as recommended curriculum for individuals involved in the investigation of child
abuse.
• 48 hours Child Abuse Training
• 32 hours Child Crimes and Sex Related Investigations
• 8 hours Basic Child Abuse Training and Prosecution
• 8 hours Child Abuse and Death Investigations
• 8 hours Medical Investigation of Child Abuse
• 7 hours Basic Forensic Interview Training
Law Enforcement Agency Activity:
AZPOST Contributions
• AZPOST was unable to deliver the anticipated training DVD. After two
years in the development stage this project was abandoned in the face of
new legislation ( see below). The Protocol is being taught at the academy
and is part of the current curriculum. Others avenues for training and
development will be pursued.
Training:
• This report contains the protocol activities of 22 law enforcement agencies
of which 16 ( 73%) submitted training activities and/ or schedules.
Compliance:
• Ofthe agencies who track notifications, no issues were reported with joint
investigative compliance procedures.
• The following table compiles law enforcement activity by ARS code
designating Extremely Serious Conduct Allegation ( ESCA) utilizing the
standardized reporting format. The combined reported total was 5,869 for
fiscal year 2008.

CPS Agency Activity
Training:
• Training courses included Advanced Forensic Interviewing and Basic 8Hour
Interviewing as well as in- house topic- related training specific to
staff needs.
• CPS reported 355 attendees participated in training courses.
Compliance:
• The Arizona Department of Economic Security, Division of Children,
Youth and Families ( DCYF) received 2,177 reports meeting the criteria
for ESCA. Seven ( 7) ofthose reports fell within tribal or military
jurisdictions and were forwarded to those agencies; therefore, a total of
2,170 reports containing ESCA's were left for joint investigation.
• A total 1,285 cases were jointly investigated in Maricopa County in fiscal
year 2008. This represents a 23% increase in joint investigations when
comparing the fiscal year 2007 with fiscal year 2008.
• Additionally, 1,035 reports that were not initially coded as ESCA
allegations were jointly investigated. This represents an increase of36%
comparing fiscal year 2007 with fiscal year 2008.

• CPS staff report improved coordination with law enforcement. Reports
initially coded as ESCA with no documentation of a joint investigation
totaled 396. This represents a 54% decrease in reports coded ESCA,
where law enforcement was notified, and no documentation of a joint
investigation exists.
Prosecution Agency Activity
Training:
• Training courses included 8 hour Basic Forensic Interviewing, 40 hour
Advanced Forensic Interviewing, 8 hour Basic Sex Crimes Investigation
as well as 40 hour courses of Equal Justice and ChildPROOF.
• Eleven prosecutors attended training.
Compliance:

comparing the fiscal year 2007 to fiscal year 2008. Submittals represented 3,526
victimsI of which 740 were under the age of 15.
• ESCA Charges Filed is defined as case( s) the County Attorney's Office
prosecutes where at least one charge reflects an ESCA. Filing decisions were
made on 2,914 charges of ESCA. This represents an 8% increase when
comparing fiscal year 2007 to fiscal year 2008. Filings represented 2,897 victims
of which 606 were under the age of 15.
• Dispositions included cases completed by deputy county attorneys that resulted in
a conviction, acquittal or dismissal. This number reflects some cases which
originated in prior fiscal years. A total of 1,598 ESCA charges reached final
disposition. This represents an 8% increase in case completions when comparing
the fiscal year 2007 to fiscal year 2008. Dispositions represented 2,823 victims of
which 504 were under the age of 15.
Resolved Issues from the Preceding Year
Last year the Committee identified several issues for stakeholders. These issues have
been addressed as indicated below:
• Issue: A 5- year review of the entire protocol is needed. Resolution: Over
the past six months the Steering Committee facilitator has coordinated
with the Executive Steering Committee and all committee members'
participation in reviewing and/ a comprehensive re- write of the entire
Protocol. The process is expected to be completed in October 2008
• Issue: Facilitate better training delivery and restructure the format for
agency reporting of training delivered and future training. Resolution: A
training DVD reflecting the comprehensive re- write and the 2008
legislative general session reforms will be created and distributed to
multiple agencies. The DVD will be distributed as soon as it is completed.
• Issue: The Steering Committee may wish to consider protocols from
other jurisdictions, not necessarily within the geographic scope of the
report. Resolution: The Governor's Office recently completed a 2- day
summit where the largest Arizona counties and CPS agreed to continue
participating in county- wide protocols as adopted by a County Attorney's
Office.

• Issue: Public access regarding CPS records. Resolution: See legislative
action passed with an effective date of September 26, 2008 designed to
improve transparency and public access regarding CPS records.
Legislative Action
• House Bill 2453 mandates that court proceedings regarding defendant
children be open to the public absent " good cause" to close such hearings.
• House Bill 2454 requires CPS to promptly provide information to the
public about cases of child abuse resulting in a fatality or near fatality,
unless releasing the information would result in a specific, material harm
to a criminal investigation.
• House Bill 2455 made several changes to Arizona statutes related to the
Protocol. This bill clarifies that the Protocols developed, adopted and
implemented in each county shall guide the conduct of investigations of
" criminal conduct" ( formerly called extremely serious conduct
allegations). The Protocols shall include standards for timely disclosure of
information and independent annual reports from CPS and each County
Attorney; CPS workers shall receive training related to victim's rights and
shall protect the rights of a child in their custody; in dependency matters,
when considering what services are to be provided to a child, the family
court shall consider information regarding a pending criminal prosecution
related to the child's removal and any orders of the criminal court.
New Items to be Researched and Evaluated for the Coming Year
• Strengthen " joint investigation" definition between MCAO, CPS and law
enforcement.
• New statutory changes to the " Extremely Serious Conduct Allegation"
definition now covers criminal conduct as defined, see Legislative Action
HB 2455 above.

designated ESCA to the Maricopa County Attorney's Office during fiscal year

Per the Protocol, upon assignment FVB, an attorney must complete the following training in the specified time periods:
1. 8- hour basic forensic inteIViewing training ( within 6 months);
2. 4o- hour advanced forensic inteIViewing training ( within one year); the attorney may audit the course;
3. 8- hour basic training on child physical abuse ( within one year);
4. The attorney must complete two of the following within two years:
a. Investigation and Prosecution of Child Abuse: Equal Justice for Children;

This information has been compiled in response to a request from Keith D. Manning, Maricopa
County Attorney's Office, for infonnation from the Department of Economic Security ( DES) to
incorporate into the annual report of activity under the inter- agency protocols mandated in
A. R. S. § 8- 817.
This information fulfills the Department's responsibility for the reporting requirement under
A. R. S. § 8- 817 for fiscal year 2008 ( July 1,2007 through June 30, 2008).
1. Number of reports coded as Extremely Serious Conduct Allegations when
received by the Agency, as defined by Title 8- 801.
The Division of Children, Youth and Families ( DCYF) received 2,177 communications
in Maricopa County in fiscal year 2008 which met the criteria for Extremely Serious
Conduct Allegations ( ESCA). Seven ( 7) of these reports were within the jurisdictions of
tribal or military governments and were sent to those agencies for response. The
remaining 2,170 reports required a joint investigation under the inter- agency protocols.
2. The number of your agency cases categorized as ESCA jointly investigated
according to the protocols.
The Division of Children, Youth and Families docUlllented 1,285 cases where joint
investigations of ESCA reports occurred in Maricopa County. This represents an increase
of 244 documented joint investigations of ESCA reports conducted in Maricopa County
compared to the prior reporting period ( fiscal year 2007).
There were an additional 1,035 reports in fiscal year 2008 that were not initially coded as
ESCA allegations that were jointly investigated. This represents an increase of 760
jointly investigated reports, not initially coded as ESCA, compared to the prior reporting
period ( fiscal year 2007).

4. Number of cases where notification was made and there is no documentation of
a joint investigation.
The majority of reports initially coded as ESCA where there is no documentation that a
joint investigation occurred are reports where CPS notified law enforcement of the report,
and law enforcement determined that the report did not meet the criteria for a joint
investigation. In fiscal year 2008, there were 396 reports coded as ESCA when the report
was initially received by CPS, where CPS notified law enforcement of the report, and
there is no documentation that a joint investigation occurred.
There were an additional 36 reports coded as ESCA when initially received by CPS
where law enforcement notified CPS of the report and there is no documentation that a
joint investigation occurred.
There were 45 additional reports coded as ESCA by the CPS Hotline where the agency
that initiated the joint investigation was not identified in the reporting database. In these
cases, the reporting database does not show that a joint investigation occurred.
While some reports do not have documentation that a joint investigation took place, CPS
staff report improved coordination with law enforcement, and DCYF management
continues to work with CPS staff to improve their documentation of joint investigations
occurring in the CPS database.
5. For CPS Only: Number of Extremely Serious Conduct Allegations included as
part of the TDM process under the Annie E. Casey Foundation grant pilot
program.
Team Decision Making ( TDM) is a decision making meeting that involves CPS, family
members, extended family, and the community where the goal is to find the safest

The Advanced Forensic Interview Training is a week long/ 40 hour class provided to CPS
Investigators by Prevent Child Abuse Inc/ Childhelp USA based in Prescott. The Division

Basic 8- Hour Forensic Training ( July 1, 2007 - June 30,2008)
The Basic Forensic Interview Training is an 8 hour training provided as part of DCYF's
Child Welfare Training Institute's Case Manager Core. It is provided by Prevent Child
Abuse Inc/ Childhelp USA at our training sites.

The agency continues to need slots for the advanced forensic training provided by
Prevent Child Abuse Inc/ Childhelp USA. Staff relate that they have found this intensive
training very helpful in teaching interviewing techniques so they can maximize the
information that they gather. Several individuals have felt that it has helped improve
documentation of pertinent information in the case file instead of unnecessary
information. Lastly, the overall feeling from staff is that they feel more competent in
their positions and report that the additioml. 1 training on interviewing skills reduces
trauma to children.

One significant success has been the opening of the Southwest Advocacy Center in
District I, Maricopa County. This Center will service the communities of Buckeye,
Goodyear, Avondale, Laveen, Waddell, Gila Bend, and several other West Valley
municipalities. This collaboration has been instrumental in enhancing the Division's
relationships with those law enforcement agencies. By coordinating responses to reports
in these communities, the quality of investigations of child abuse and neglect have
improved.
All co- located staff in Advocacy centers across Maricopa County report great working
relationships with law enforcement and the County Attorney's office. In fact, Childhelp
has begun weekly staffings to discuss high profile or problematic cases. Each entity is
invited for the discussion to enhance learning as a team on how to best improve joint
responses to the children and families.
District staff report improvements in responses by law enforcement compared to previous
years. Much of this success is due to CPS supervisors and assistant program managers
meeting on a consistent basis with their law enforcement partners.
Furthermore, CPS field specialists have noted an improved working relationship between
CPS and law enforcement agencies during this reporting period.
The Division looks forward to the upcoming statewide meeting on August 12th and 13th
between law enforcement and child protective services to discuss improvements to the
joint investigation protocols.
Follow- Up Action Steps
The Division continues to provide CPS case managers with a tip sheet on appropriately
documenting the joint investigation in the CHILDS database system.
As requested in the Maricopa County Attorney's Office 2007 report, DCYF has been tracking
additional detailed information related to extremely serious conduct allegations, as outlined
below:

The Arizona Department of Public Safety ( AZ DPS) is not a law enforcement
agency with primary investigative jurisdiction for the crimes identified in this
report. The AZ DPS will conduct investigations upon. requests from outside
agencies or for crimes encountered during the course of our mandated missions.
Outside agency requests require approval from the Director.
When a uniformed or undercover AZ DPS officer comes into contact with a child
fitting into one of these categories, the local municipal or county police agency is
summoned to the incident scene to assume investigative responsibilities for that
specific criminal violation. If the agency ofjurisdiction is unable to respond or
requests that AZ DPS conduct the investigation we will assume the primary
investigative role. This is due to the fact that the crimes identified involving
children, do not routinely occur on the state highways or in the routine course of
business for AZ DPS Detectives.
DPS officers do investigate crimes unique to the movement of traffic on the state
highways and some · ofthese crimes peripherally involve children. Examples are
DUI driving, collisions, reckless driving, or narcotics related offenses where the
child was a passenger or was within proximity to the crime scene, but the child was
not the specific focus of identifiable criminal intent. AZ DPS Detectives also
encounter child crime cases during the service of search warrants and the
investigations of other crimes.

8. The EI Mirage Police Department came under new management in October
of 2007. The Investigations Division has undergone a complete
reorganization including a modified case management system. We
investigate numerous child- related crimes and are changing our case
management menu to more accurately reflect the ECAS crimes. We have
been a frequent visitor to the New Southwest Family Advocacy Center and
have been very pleased with all the support.

The Glendale Police Department's Child Crimes/ Family Violence units had
544 cases reported to the department in regards to possible criminal acts
against children less than eighteen years of age. In those cases 324 required
a joint investigation between law enforcement and Child Protective Services.
This was accomplished by working with the assigned C. P$. investigators at
the West Valley Advocacy center and working with the C. P. S. offices
assigned to the City of Glendale. Please refer to the attached clearance sheet
regarding closures status of the 324 cases.
The Glendale Police Department currently meets daily with the C. P. S.
investigators assigned at the advocacy center and also speaks with the
supervisors at the relevant offices in regards to reports both report to C. P. S.
and law enforcement. In the listed time frame there were no occurrences
where C. P. S. did not respond to work ajoint investigation regarding the 324
cases.
The following is the trainings that were provided to detectives and patrol
officers either at the center or another advocacy center in the metropolitan
area.
Two detectives and one patrol officer were sent to the Basic Investigation of
Sexual Crimes against Children which is mandated by the protocol. This
training is provided by a detective from the West Valley Advocacy Center
and the roster for attendance is on file at the Governors office.
One detective was sent to the Basic Forensic Interview training and a second
was sent to 40 hour advanced training as required by the protocol.
The West Valley Advocacy Center also hosted two Mandatory Reporter
trainings and assisted in presenting the information.
Currently two detectives still need to attend the Physical Abuse Training as
mandated by the protocol and two detectives need to attend the 40 Advanced
Forensic interview training.

The Goodyear Police Department understands that the primary objective in improving the
effectiveness of child abuse investigations and prosecutions is to actively participate in
the multi- disciplinary approach to child abuse investigations. The department is currently
a partner in the operation of the Southwest Valley Family Advocacy Center with the
following resources:
( 2) Crimes against children detectives
These detectives also investigate adult sex crimes, missing persons, domestic violence
related crimes and sex offender registration.
The Southwest Valley Family Advocacy Center also offers the therapy component, crisis
services staff, forensic interviewers, on- call forensic pediatricians and on- call forensic
nurse examiners. Child Protective Services ( CPS) has seven investigators, one case aid
and a CPS supervisor, assigned to the center.
The Goodyear Police Department received 117 cases under the listed statutes that fall
into the " Extremely Serious Conduct Allegation" ( ECSA) category. These cases were
investigated by both law enforcement and CPS, within the guidelines of the Maricopa
County Multidisciplinary Protocol for the Investigation of Child Abuse. Disposition of
these cases are provided in the disposition logs of this report.
The Goodyear Police Department provided training for patrol officers on the Maricopa
County Protocol and mandatory reporting. The crimes against children and persons
crimes detectives have all attended the mandatory basic and forty ( 40) hour forensic
interview training, with an additional two detectives having attended the forty ( 40) hour
forensic interview course in 2007. Both crimes against children detectives have
completed the required physical abuse and child sexual abuse investigations training, as
well as the Crimes against Children Conference in San Diego, California in January
2008. The crimes against children detectives participate in forensic interviewer peer
review once per month at the center.

Since the opening of the Southwest Valley Family Advocacy Center in 2008, the
Goodyear Police Department has found that the multidisciplinary approach to the
investigation of child abuse has been more efficient now that all disciplines are now in

by the City ofPeoria Police Department Criminal investigations Bureau and the Department

The Phoenix Police Department has collected information in compliance with Title 8- 817 to be
included in the consolidated report for Maricopa County regarding activities under the
Multidisciplinary Investigation of Child Abuse Protocol. Attached you will find the completed
statistical form for the 2007/ 08 fiscal year, based on the established Arizona Revised Statutes
and departmental case dispositions. Backup documentation for the report is available upon
request.
Our Department continues to be committed to the pursuit of justice involving all crimes, including
extremely serious conduct allegations involving children. We work closely with Cbild Protective
Services ( CPS) on all allegations of extremely serious conduct by a parent, legal guardian, or
custodian ( per their definitions). Our Crimes Against Children Detail, located at the Childhelp
USA Advocacy Center, continues to work daily with all members of the Multidisciplinary Team.
Our partnerships provide a collaborative effort and facilitate compliance with the Maricopa County
Multidisciplinary Protocol for the investigation of child abuse. The exchange of information and
available resources each partner brings to the table is an ongoing daily activity providing the most
comprehensive and victim friendly process for the victims and their families in this traumatic
time.
Training is also an ongoing priority for the personnel in our Crimes Against Children Detail in
terms of ensuring that employees are aware of the services available for victims, and in terms of
continuing to advance their knowledge and skills. The Crimes Against Children Detail
provides informal, on- going first responder training to our patrol officers whenever requested to
help explain the services available for victims. In addition, during the 2007/ 08 fiscal year,
personnel from the Crimes Against Children Detail attended multiple training classes to advance
their skills. Four people attended a 40 hour advanced forensic interview course, four people
attended an 8 hour basic forensic interview course, eight people attended a 16 hour " Inside the
Mind of the Sexual Predator" training course, three people attended an 8 hour cellular phone
training course, and six people attended the REID's " Child Abuse and Computer Facilitated Child
Crimes" seminar.

statistics for the fiscal year 2007 - 2008.
The Wickenburg Police Department does not interview victims of child
abuse, sexual assault, kidnapping, or any other crimes pertaining to the
protocol outline. This department uses Childhelp for all of our interviews.
We are currently working on department training to up date all of our
officers on our department's policy regarding interviews with victims of
these crimes.

The Maricopa County Multidisciplinary Investigation of Child Abuse Protocols Committee on
Training and Compliance will continue to fulfill statutory duties pertaining to legislation. A. R. S. § 8817
requires that an annual report of activity under the protocols be transmitted to the Governor, the
Speaker ofthe House of Representatives and the President of the Senate within 45 days of the end of
each fiscal year. [ A. R. S. § 8- 817 Co 6. & 7.]. The Committee intends this letter to be its notice ofthe
requirement under the statute for the fiscal year 2007 - 2008.
The Committee will again submit a consolidated report within the required time frame. To this end, the
cooperation of each agency will be required. Please be advised that if your agency chooses not to
participate in our combined report for Maricopa County, the statutory duty remains in place and you
are required to send a report of your activities under the Multidisciplinary Investigation of Child Abuse
Protocol to the mandated recipients [ listed in A. R. S. § 8- 817 C. 7.]. If you choose not to participate in
the consolidated report, please notify me and provide a copy of the independent report.

As required by statute, the Maricopa County Multidisciplinary Investigation of Child Abuse
Protocols Committee on Training and Compliance will collect statistics and issue a report of
activities of agency participants. The Multidisciplinary Investigation ofChild Abuse Protocols will
include information on training and compliance from contributing agency participants.
Please complete the attached form using the definition and related Arizona Revised Statutes listed

§ 8- 817. Initial screening and safety assessment and investigation protocols; investigations;
disclosure of information
A. The department shall develop initial screening and safety assessment protocols in consultation with the
attorney general and statewide with county attorneys, chiefs of police, sheriffs, medical experts, victims'
rights advocates, domestic violence victim advocates and mandatory reporters. Any initial screening and
safety assessment tools shall be based on sound methodology and shall ensure valid and reliable responses.
The department shall establish written policies and procedures to implement the use of the initial screening
and safety assessment protocols.
B. In each county, the county attorney, the sheriff, the chief law enforcement officer for each municipality
in the county and the department shall develop and implement protocols for cooperation in investigations of
allegations involving extremely serious conduct. The protocols shall include:
1. The process for notification of receipt of extremely serious conduct allegations.
2. The standards for interdisciplinary investigations of specific types of abuse and neglect, including timely
forensic medical evaluations.
3. The standards for interdisciplinary investigations involving native American children in compliance with
the Indian child welfare act.
4. Procedures for sharing information.
5. Procedures for coordination of screening, response and investigation with other involved professional
disciplines and notification of case status.
6. The training required for the involved child protective service workers, law enforcement officers and
prosecutors to execute the investigation protocols, including forensic interviewing skills.
7. The process to ensure review of and compliance with the investigation protocols and the reporting of
activity under the protocols.
8. Procedures for an annual report to be transmitted within forty- five days after the end of each fiscal year
to the governor, the speaker of the house of representatives and the president of the senate.
9. Procedures for dispute resolution.
C. The department, the appropriate county attorney and the appropriate law enforcement agency shall
cooperate in the investigation of every extremely serious conduct allegation in accordance with the
investigation protocols established pursuant to this section. Before it releases records it receives from the
department pursuant to an investigation, the law enforcement agency shall take whatever precautions it
determines are reasonably necessary to protect the identity and safety of a person who reports child abuse
or neglect and to protect any other person the agency believes could be endangered by the disclosure of the
CPS information. The law enforcement agency is not required to disclose CPS information if the disclosure
would compromise the integrity of a child protective services or criminal investigation.

HISTORICAL AND STATUTORY NOTES
Laws 2003, 2nd S. S., Ch. 6, § § 43 and 44, provide:
" Sec. 43. Protocols for initial screening and safety assessments
" The department of economic security shall develop the protocols for initial screening and safety
assessments of child abuse and neglect allegations pursuant to § 8- 817, Arizona Revised Statutes, as
added by this act, on or before July 1, 2004.
" Sec. 44. Protocols for joint investigations
" The county attorney in each county, the county sheriff, the chief law enforcement officers of each
municipality in the county and the department of economic security shall develop the protocols for joint
investigations of extremely serious conduct allegations pursuant to § 8- 817, Arizona Revised Statutes, as
added by this act, on or before July 1, 2004."

§ 8- 801. Definitions
In this chapter, unless the context otherwise requires:
1. " Child protective services worker" or " worker" means a person who has been selected by and trained
under the requirements prescribed by the department and who assists in carrying out the provisions of this
article.
2." Extremely serious conduct allegation" means an allegation of conduct by a parent, guardian or
custodian of a child that, if true, would constitute any of the following:
( a) A violation of § 13- 3623 involving child abuse.
( b) A felony offense that constitutes domestic violence as defined in § 13- 3601.
( c) A violation of ~ 13- 1404 or 13- 1406 involving a minor.
( d) A violation of § 13- 1405, 13- 1410 or 13- 1417.
( e) Any other act of abuse that is classified as a felony.
3. " In- home intervention" means a program of services provided pursuant to article 7 of this chapter while
the child is still in the custody of the parent, guardian or custodian.
4. " Protective services" means a specialized child welfare program that is administered by the department
as provided in this chapter and that investigates allegations of and seeks to prevent, intervene in and treat
abuse and neglect, to promote the well- being of the child in a permanent home and to coordinate services to
strengthen the family.
