EXECUTIVE ORDERS, PROCLAMATIONS OF GENERAL APPLICABILITY, AND STATEMENTS ISSUED BY THE GOVERNOR PURSUANT TO A.R.S. ? 41-1013(B)(3)
The Administrative Procedure Act (APA) requires the full-text publication of all Executive Orders and Proclamations of General Applicability issued by the Governor. In addition, the Register shall include each statement filed by the Governor in granting a commutation, pardon or reprieve, or stay or suspension of execution where a sentence of death is imposed. PROCLAMATION IN ACCORDANCE WITH ESTABLISHED EMERGENCY PROCEDURES WHEREAS, remnants of Hurricane Nora brought heavy rains and extensive flooding into the State of Arizona; and WHEREAS, these conditions created a situation of extreme hazard to the safety of citizens of the State; and WHEREAS, these conditions had caused severe hardship on affected political subdivisions of the State by exhausting their available resources to provide emergency relief; and WHEREAS, the Legislature had authorized the expenditure of funds in accordance with established procedures contained in A.R.S. ? 35-192, A.A.C. R8-2-301 to 321, and Executive Order 79-4; WHEREAS, authorization to activate the State Emergency Operations Plan and invoke provisions of A.R.S. ? 26-309 to provide mutual aid assistance and A.R.S. ? 26-303.A.1 emergency purchasing to stricken areas of the State; NOW, THEREFORE, I, Jane Dee Hull, Governor of the State of Arizona, pursuant to the authority vested in me by the Constitution and Laws of the State of Arizona, do hereby terminate the declaration of the state of emergency of September 24, 1997. All unexpected funds allocated to the emergency shall revert to the General Fund. IN WITNESS WHEREOF, I have hereunto set my hand and caused to be affixed the Great Seal of the State of Arizona. Secretary of State EXECUTIVE ORDER 99-12 Supersedes Executive Order 94-1 establishing the Arizona Commission for National and Community Service RENAM ING AND EXPANDING THE GOVERNOR'S COMMISSION ON SERVICE AND VOLUNTEERISM WHEREAS, in order to broaden the scope and perspective of this Commission, the name of this body shall be the Governor 's Commission on Service and Volunteerism. WHEREAS, there is a need for citizen participation in addressing community needs and promoting community interaction through volunteer efforts; and WHEREAS, promoting the potential of Arizona's people, communities, and enterprises in terms of working collaboratively toward the prosperity of Arizona; and WHEREAS, building and encouraging volunteerism and service as an integral part of the state's future well-being, requiring cooperative efforts by the public and private sectors; and WHEREAS, the development of volunteer programs and centers requires an administrative vehicle which conforms with federal guidelines and funding detailed in the National and Community Service Trust Act of 1993; NOW, THEREFORE, I, Jane Dee Hull, by virtue of the authority vested in me as Governor of the State of Arizona, do hereby order as follows: I. The Governor's Commission on Service and Volunteerism is hereby empowered to advise and assist in the development and implementation of a comprehensive, statewide plan for promoting volunteer involvement and citizen participation in Arizona, as well as to serve as the State's liaison to national and state organizations which support the Commission's mission. II. The Commission will be composed of no less than 15 and no more than 25 voting members to be appointed by the Governor in compliance with federal guidelines as described in the National Community Service Trust Act of 1993, and as detailed below: A. and developmental needs of youth; an individual with experience in the involvement of older adults in service and volunteerism; a representative of community-based agencies within the state; a representative of the Arizona Department of Education or his/her designee; a representative of Higher Education; a representative of local government; a representative of a local labor organization; a representative of a for-profit business; an individual between the ages of 16 and 25 who is, or has been, involved with a service or volunteer program; a representative of the Corporation for National and Community Service who shall serve as a non-voting, ex officio member. B. Not more than 25 percent of the Commission members may be employees of state government, though additional state agency representatives may sit on the Commission as nonvoting ex officio members. C. Not more than 50 percent of the Commission, plus one member, may be from the same political party. To the extent possible, the composition of the Commission will reflect the diversity of the state's population. D. The members of the Commission will select the Commission Chair. E. Members will serve at the Governor's pleasu r e . III. The Governor's Commission on Service and volunteerism will be supported in partnership with the governor 's Community Policy Office and will have the following duties and responsibilities: A. Establish and maintain a statewide Strategic Planning for Volunteerism and Service. B. Fulfill all federal program and administration guidelines, reports, and financial records for AmericCorps, Learn and Serve America, and special programs as made available by the Corporation for National Service and other funding entities. C. Integrate AmeriCorps, Service Learning, Senior Service, AmeriCorps*VISTA and Volunteer Centers into the state strategic plan for service and volunteerism to eliminate duplication and support creative collaborations. D. Encourage and support Arizona citizens to give their time and talent to provide solutions to community needs. E. Prepare an annual report on the Commission's progress for submission to the governor. F. To promote the broadest possible base of participation and to dispel exclusion, Commission members will be eligible to apply for a pre-determined limit of funding directed by the Commission if a member of the Commission was a volunteer or employee of the said organization at any time during the preceding 24 months. IV. The Governor's Office shall serve, as the lead agency for administration of the Commission, and as is deemed appropriate and necessary to fulfill the objectives of this Order. Additionally, all State agencies will provide assistance to the Commission in order to ensure a fully coordinated state effort for promoting Service and Volunteerism. The Commission is authorized to accept funds and in-kind services from other state, private, and federal entities. V. The Governor's Commission on Service and Volunteerism shall be reviewed no later than June 30, 2003 to determine appropriate action for its continuance, modification, or termination.
