EXECUTIVE ORDER 2000-13 To Allocate Funds to Ensure Continuation of Kidney Dialysis Services in the Rural Area of Eastern Pinal and Southern Gila Counties
WHEREAS, the rural area of Eastern Pinal and Southern Gila Counties, especially the area between Kearny and San Manuel, has very limited health care services available and has been officially designated as a medically underserved area in this state; and WHEREAS, there is a regional demand for kidney dialysis in that area, with the number of patients projected to be 41% higher in 2003 than in 1998; and WHEREAS, kidney dialysis is a procedure performed on an individual with end stage renal disease three times a week for approximately four hours per session; and WHEREAS, a large number of persons in the area must travel 75 or more miles each way for each treatment, with the recipients being frail or elderly; and WHEREAS, such an arduous trip can be deleterious to the health of these individuals and can lead to health crises; and WHEREAS, a feasibility study commissioned by Copper Communities Resource and Development, Inc. and completed by ESI Corporation of Phoenix concluded that there is sufficient demand in the area to allow for a financially viable kidney dialysis center; and WHEREAS, BHP Copper has submitted to this state a letter of commitment to donate land to Copper Communities Resource and Development, Inc. in Mammoth, Arizona upon which a kidney dialysis center can be constructed; and WHEREAS, county and local community leaders in that area have expressed a commitment to secure funding necessary in addition to that being provided through this Executive Order for construction and operation of a kidney dialysis center; and WHEREAS, during the 1997 First Regular Session of the Forty-third Legislature, the Health Crisis Fund was established, authorizing the Governor to expend funds in order to respond to an existing health crisis; NOW, THEREFORE, I, Jane Dee Hull, Governor of the State of Arizona, by virtue of the authority vested in me by the Constitution and Laws of the State, do hereby declare a health crisis or a significant potential for a health crisis in this State and hereby, 1. Allocate such additional funds as necessary, not to exceed $250,000 from the Health Crisis Fund as established pursuant to A.R.S. ? 36-797 to the Department of Health Services, to be placed in an account to be used to pay Copper Communities Resource and Development, Inc. for a portion of the costs of: 1) professional services required to complete pre-development activities and 2) the construction of a kidney dialysis center in Mammoth, Arizona. Examples of professional services are engineering, architectural design, and environmental assessments. Professional services do not include any administrative expenses of Copper Communities Resource and Development, Inc. No more than 40% of the funds may be used for predevelopment activities. Release of any funds for the actual construction of the kidney dialysis center shall be contingent on Copper Communities Resource and Development, Inc. demonstrating to the satisfaction of the state that it has secured sufficient total funds to complete construction of the kidney dialysis center, and has met the deliverables identified by the Department. None of these funds shall be used for the purchase or lease of any land. Direct the Department of Health Services to report monthly on the expenditure of funds from the account on activities related to pre-development and construction of a kidney dialysis center in Mammoth, Arizona to the Governor and the Joint Legislative Oversight Committee on the Tobacco Tax and Health Care Fund pursuant to A.R.S. ? 36-797. Any monies in the account that are unspent within eighteen months of the date of this executive order shall be returned to the state to be deposited in Medically Needy Account of the Tobacco Tax and Health Care Fund account established pursuant to A.R.S. ? 36-774.
