EXECUTIVE ORDERS, PROCLAMATIONS OF GENERAL APPLICABILITY, AND STATEMENTS ISSUED BY THE GOVERNOR PURSUANT TO A.R.S. ? 41-1013(B)(3)
The Administrative Procedure Act (APA) requires the full-text publication of all Executive Orders and Proclamations of G eneral Applicability issued by the Governor. In addition, the Register shall include each statement filed by the Governor in granting a commutation, pardon or reprieve, or stay or suspension of execution where a sentence of death is imposed.

EXECU TIV E ORDER 2000-20 Supersedes Executive Order 2000-3 GOVERNOR'S BROWN CLOUD SUMMIT
WHEREAS, the Valley of the Sun has made significant strides in improving air quality, with no m easured violations of the National Ambient Air Quality Standards for carbon monoxide and ozone in 1997, 1998 and 1999 and thus far in 2000; and WHEREAS, implementation of the recommendations of the Governor 's Air Quality Strategies Task Forces appointed in 1996 and 1997 contributed to this success; and WHEREAS, the Valley of the Sun must dem onstrate attainment of the particulate matter standard by 2006; and WHEREAS, the Valley of the Sun must also demonstrate maintenance of the carbon monoxide and ozone standards, and continue to achieve healthful air for these pollutants through 2015; and WHEREAS, elevated levels of ozone and carbon monoxide pollution can worsen respiratory problems, including bronchitis, emphysema and asthma, while creating breathing problems for otherwise healthy individuals, particularly the elderly and young children; and WHEREAS, improving the health of citizens and visitors, along with providing them the opportunity to more clearly view Arizona's spectacular vistas improves the quality of life and economic well-being in the Valley of the Sun; and WHEREAS, carbon particles and nitrogen dioxide gas create the brown color of the haze that hangs over the Valley of the Sun, referred to as the "brown cloud"; and; WHEREAS, visibility measurements taken over the course of the past four years show a substantial increase in the density of the brown cloud, particularly on days when citizens and visitors should be able to see most clearly, but increasingly cannot; and WHEREAS, citizens of the Valley of the Sun have shown an interest in and concern with the brow n cloud, and seek action to further protect public health and im prove visibility; and WHEREAS, the Grand Canyon Visibility Transport Com mission, with the State of Arizona in a lead role, adopted specific local visibility improvement strategies for the western United States; and WHEREAS, the Western Regional Air Partnership is working to facilitate implementation of the recommendations of the Grand Canyon Visibility Transport Comm ission; and WHEREAS, strategies that improve urban visibility may lead to additional reductions in ozone and particulate matter pollution, further protecting the health of our citizens; and WHEREAS, the complexity of the problem and need for new strategies necessitate timely action to assist in the evaluation of potential measures to reduce the brown cloud, and to assess its impacts on related pollutants, health hazards, urban visibility, quality of life and the economy; NOW, THEREFORE , I, Jane Dee Hull, by virtue of the authority vested in me as Governor of the State of Arizona by the Constitution and Laws of the State, do hereby establish the Governor 's Brown Cloud Sum mit to identify and examine strategies to improve visibility in the Valley of the Sun, which, in turn, will enhance the well-being of the State's residents. 1. The Brown Cloud Summit shall be com prised of not fewer than 20 mem bers appointed by the Governor. The Chairm an shall be appointed by the Governor.

2. 3. 4. Members appointed by the Governor shall serve at the pleasure of the Governor. Members may name non-voting alternates to represent them at Summ it meetings. The Brown Cloud Summit shall: a. Identify strategies to improve visibility in the Valley of the Sun, recognizing the relationship to ozone and particulate matter, and considering the interactions between these pollutants and the measures to control them. In so doing: 1) The Sum mit shall consider all control measures recommended in the February 17, 1998, Report of the Governor 's Air Quality Strategies Task Force that have not been implemented, and all control measures considered, but not recommended. 2) The Sum mit shall review measures that would im prove urban visibility that are either under consideration or currently implemented in other states and evaluate their feasibility in Arizona. 3) The Summit shall prepare a report to the Governor describing the process and methods used to evaluate potential m easures and make recomm endations on im plementation of measures. Each recomm endation shall include a time line for implementation, identification of the parties responsible for implementation, an evaluation of cost effectiveness, and a m eans to evaluate the success of each measure. 4) The Summit shall assess the im pact of implem entation of recommended measures on those sectors of the economy directly affected and, to the extent feasible, the economy of Maricopa County, neighboring communities and the State. b. Where possible, consider the relationship of potential m easures to the recommendations of the Grand Canyon Visibility Transport Commission and the work of the Western Regional Air Partnership. c. Solicit and receive comments from citizens, governmental agencies and other affected parties, on an ongoing basis and as an official part of each Summit meeting. d. Develop proposals for legislative, regulatory, administrative, voluntary and local government action. Advocate for and assist in the adoption and implementation of these strategies. Prepare a draft report addressing the topics and issues identified in section 4 above, and provide a public review and comment period of at least 2 weeks. An Interim or final report shall be completed on or before December 15, 2000. If an interim report is submitted, the Summit shall complete Arizona final report on a date determined by the Chair.
