WHEREAS, the Department of Health Services budget, which includes the Laboratory, requires additional funds to accommodate the increased costs associated with the unanticipated demands on the Laboratory; and WHEREAS, a fully functioning and responsive Laboratory is vital to the health and safety of the residents of Arizona; and WHEREAS, during the 1997 First Regular Special Session of the Forty-third Legislature, the Health Crisis fund was established, authorizing the G overnor to expend funds in order to respond to an existing health crisis; NOW, THEREFORE, I, Jane Dee Hull, Governor of the State of Arizona, by virtue of the authority vested in me by the Constitution and Laws of the State, do hereby declare a health crisis or a significant potential for health crisis in the State and hereby, 1. Allocate $350,000 from the Health Crisis Fund as established pursuant to A.R.S. ? 36-797 to the Department of Health Services, for the operation of the State Laboratory, including costs related to hiring additional staff, overtime pay, supplies, equipment, public information and interagency communications. 2. Direct the Department of Health Services to report the expenditures of these funds to the Joint Legislative Oversight Committee on Tobacco Tax and Health Care Fund pursuant to A.R.S. ? 36-797. 3. Any monies in the account that are unspent within eighteen months of the date of this executive order shall be returned to the state to be deposited in the Medically Needy Account of the Tobacco Tax and Health Care Fund account established pursuant to A.R.S. ? 36-774. EXECUTIVE ORD ER 2001-18 TO A LLOC ATE FUNDS TO CONTINUE HEALTH SERVICES PROVIDED BY THE BORDER HEALTH FOUNDATION WHEREAS, social, cultural, political, legal, ecological, historical and economic factors along with the United States-Mexico border region create unique challenges for dealing w ith myriad health problems; and WHEREAS, the Border Health Foundation (BHF) was established in 1984 to address health issues, with specific programs in diabetes, substance abuse, HIV/AIDS, water-borne diseases and tobacco use; and WHEREAS, the BHF's health-related programs have provided services over 5000 individuals and families in three Arizona Field Offices; and WHEREAS, since its inception, the BHF has relied mainly on Federal grants for funding; and WHEREAS, for Fiscal Year 2002 some of those grants have not been renewed and the grants that the BH F has obtained will not be available until January, 2002, leaving a short-term funding shortfall; and WHEREAS, the BH F des not have sufficient reserves to sustain its programs from October through December 2001 and will have to stop the delivery of medical services; and Volume 7, Issues 27-52 Page 8 December 31, 2001

WHEREAS, failure to provide these health services will increase the potential for passing on numerous ailments to other atrisk populations and increase the numbers of persons requiring emergency medical services, at significant cost to hospitals and the state; and WHEREAS, during the 1997 First Regular Session of the Forty-third Legislature, the Health Care Crisis Fund was established, authorizing the G overnor to expend funds in order to respond to an existing health crisis; NOW, THEREFORE, I, Jane Dee Hull, Governor of the State of Arizona, by virtue of the authority vested in me by the Constitution and Laws of the State, do hereby declare a health crisis or a significant potential for health crisis in the State and hereby, 1. Allocate, on a one-time basis, $80,000, from the H ealth Care Crisis Fund as established pursuant to A.R.S. ? 36-797 to the Department of Health Services, to be distributed as bridge funding, for continuation of the health services provided through the Border Health Foundation. Direct the Department of Health Services to report the expenditures of these funds made by the Border Health Foundation to the Joint Legislative Oversight Committee on the Tobacco Tax and Health Care Fund pursuant to A.R.S. ? 36-797.
