Executive Order 2003-08 TO LOAN MONEY FROM THE HEALTH CRISIS FUND TO WINSLOW MEMORIAL HOSPITAL WHEREAS, pursuant to A.R.S. ? 36-797, the Legislature has established the Health Crisis Fund empowering the Governor to authorize specific liabilities and expenditures in order to respond to a health crisis or a significant potential for a health crisis; and WHEREAS, Winslow Memorial Hospital is a non-profit 501(C)(3) organization serving as the only hospital in the Winslow, Arizona community; and WHEREAS, Winslow Memorial Hospital has suffered significant and unexpected financial losses that pose an immediate threat to its ability to continue operations; and WHEREAS, the threat of losing Winslow Memorial Hospital constitutes a significant potential for a health crisis to the Winslow, Arizona community; and WHEREAS, the unexpected financial losses at Winslow Memorial Hospital are not of the type of emergencies, contingencies or disasters contemplated by A.R.S. ? 35-192, NOW, THEREFORE, I, Janet Napolitano, Governor of the State of Arizona, by virtue of the authority vested in me by the Arizona Constitution and the laws of the State, declare a significant potential for a health crisis in this State and hereby order as follows: 1. The Health Crisis Fund, as established pursuant to A.R.S. ? 36-797, is authorized to loan the sum of two hundred thousand dollars to Winslow Memorial Hospital. Such funds shall be used by the hospital for its continued operations in accordance with statutory and contractual obligations. This loan shall be contingent upon Winslow Memorial Hospital executing a Loan Agreement, Promissory Note (the "Note") and other documents requested by, and in a form satisfactory to, the Governor. Winslow Memorial Hospital shall fully reimburse the loan amount, plus interest as set forth in the Note, to the medically needy account of the tobacco tax and health care fund, pursuant to the terms of the Note.
