prepare legal cases on fraud or malpractice as seems most suitable based upon instances in the files of the Industrial Commission, and prosecute them in the name of the Association.
Peculiar irregularities in the manner of conducting the office of the State Board of Medical Examiners were taken up, and it was moved that the Council recommend to the Interim Legislative Committee that all privately supported Boards in the future turn over their present funds and all future income that they may receive to the general fund or to the state treasurer, and all expenses incurred by these boards hereafter be paid through the state treasurer's office.
A letter from Dr. J. Whitehill concerning alleged splitting of fees between doctors and laboratories in town was read by Dr. Thompson. This letter contained a resolution suggested by Dr. Whitehill.
Dr. Hayden-"Has he proof?"
Dr. Lewis:-"On the same order, I have heard that there is fee splitting with rest homes."
Dr. Farness: "Druggists have also told me that they have been approached for rebate."
Dr. Cogswell-"It is only right to bring this letter up before the Society for vote on it to see whether they want to make this resolution."
Dr. Hugh Thompson stated that Mr. Ginsberg [ Ginsburg ], of the Stone and Third Pharmacy, had spoken to him again about the proposed dinner for doctors, dentists and druggists, and that some decision should be reached by the Society about going to this, and a reply given. Dr. Farness moved that the Secretary be instructed to inform Mr. Ginsberg [ Ginsburg ] to go ahead with his meeting whenever he desires it and send invitations to the members of the medical society. Dr. Steen suggested that this be brought up before the meeting of the Society.
Dr. Hayden spoke about Dr. Paul Bennett, who is not a participating member of Blue Shield because of being a dentist, but who does maxillo-facial surgery. Dr. Hayden suggested that the secretary of the County Society be instructed to write the Board of Directors of the Arizona Blue Shield requesting that Dr. Bennett be invited to become a participating members of Blue Shield, making an exception in his case because of his being a dentist, and limiting his participation to emergency maxillo-facial surgery. Dr. Farness seconded the motion. Dr. Lewis suggested that were this to be done it would set a precedent for others and felt that it might be better for Dr. Bennett to call Dr. Hayden, and receive authorization. Dr. Hayden thereupon withdrew his motion.
Dr. Hayden spoke about the suggested revision of the By-Laws, giving the following:
Amendment to Chapter 1, Section 1, Paragraph 5, page 13:
There after Delegates shall be elected yearly on the basis of one-third the number of Delegates permitted by Arizona Medical Association for terms of three years each, and any lesser fraction thereof shall be elected for a one year term only. [ following text underlined ] In the primary election three times the number of vacancies to be filled shall be selected as candidates without distinction as to years of tenure, and at the final election those receiving the highest number of votes in order shall be declared elected for three years, and those receiving the next highest number of votes shall be elected for one year as Delegates, until all offices of Delegates are filled; and according to the highest number of votes received thereafter the Alternate Delegates for that year shall be selected, in number equal to the total number of Delegates. [ underline ends ] Should a Delegate-(etc. down to the last sentence)- [ following text underlined ] No Delegate shall succeed himself by election until a lapse of three years who has served as a Delegate for more than one year.
