Board of Directors Meeting, January 29, 1952 2
Dr. Hayden--I read him a copy of the charges. He discussed it with us that night and wrote us the following day, repeating point by point, almost verbatim.
Dr. Beaton--I am sure from my conversation with him that the point he is making most strongly is that he is not allowed to present affidavits in his own defense.
Dr. Hewitt--Unfortunately, he is on good ground.
Dr. Farness--The statement that his conduct is displeasing to the majority of the members should take care of that.
Dr. Hastings--Ray, when he met with the Board of Censors the charges were read to him, every one, and he took it up step by step and went home and prepared a written statement regarding the various points. At no time did he offer to put up any defense. He eve falsified his office records, because he got mixed up and stated he was treating this woman for an accident one day before she had it.
Dr. Hewitt--I think this is hot and we are on dangerous ground.
Dr. Beaton--Where do you feel we are not on legal ground?
Dr. Steen--We in the office acknowledge and state the complaint has been received and then sent it on to the Board of Censors.
Dr. Harry Thompson--It was investigated and he was presented with the charges.
Dr. Hugh Thompson--As a matter of discussion, I would suggest that Dr. Lieberman be sent a copy of the charges and then he will have them in writing and I think we should tell these people we have investigated very thoroughly and that the decision was definitely arrived at and that is it.
Dr. Hayden--Dr. Lieberman wants to sue N_____. If he does, the boy will counter sue for a number of things.
Dr. Hewitt--I think the first and only thing we ought to do now is to consult a lawyer.
Dr. Harry Thompson--The Censors said they would not proceed without one.
Dr. Hastings' motion, upon being put to vote, was carried.
Dr. Hastings--Now, as a member of the Board of Censors, I think it would be advantageous for the Board of Directors to suggest whom they would like us to employ for advice. We had Knapp, Boyle, Bilby & Thompson when we arranged the By-Laws.
Dr. Hayden--Mr. McCarty is Lieberman's lawyer, and has withdrawn from the case in order to be a witness for Lieberman, and the case turned over to Krucker, Evans & Kemper.
Dr. Steen--I make a motion that we secure the services of Knapp, Boyle, Bilby & Thompson. Motion was seconded by Dr. Manning.
Dr. Kohl--First, before we decide whom we will engage, I should like the Board of Directors to authorize the Board of Censors to spend the money necessary, and if you wish to limit the amount you are willing to spend on an attorney.
Dr. Steen--In view of the fact that we are going to have to employ a lawyer, I have not yet purchased the bonds in accordance with Dr. Harry Thompson's motion of last month.
Dr. Lesemann--Let us amend the motion to spend whatever amount is necessary to accomplish it.
Dr. Harry Thompson--Do you want to be held to this particular attorney?
Dr. Kohl--I have no particular choice.
Dr. Harry Thompson--there are six people you can choose from.
Dr. Kohl--I do not think the charge will be great because I do not think it will come to court, as there are no grounds for suit. Probably
