Senator Jack Brown is one of those rare commodities; he is a
native Arizonan. He is a life long resident of St. Johns and has for
28 years defended and represented the interests of rural Arizona
at the legislature. “I have always been known as a strong
proponent for rural Arizona. Many people believe Maricopa
County is Arizona. I am here to ensure that rural areas and their
interests, aren’t gobbled up by these fast growing urban areas.”
Senator Brown, who has a degree in Agriculture and Economics
from Brigham Young University and a background in farming,
ranching and real estate, says many legislators don’t understand
the issues facing rural Arizona. Money for roads and dollars for
small rural schools are keys to the survival of rural areas, he says.
In contrast to most legislators Senator Brown has to pay much
attention to county governments. He currently represents six
county governments and 25 board of supervisors’ members.
Since 1997, when Senator Brown was elected to the Senate, he has been the minority leader.
But, Brown says, it wasn’t until last session that his position gained recognition. “It didn’t
mean a whole lot until it got to be 15-15 split. And when it got to be a 15-15 split it’s a whole
different ball game.” Senator Brown says compromising and working together across party-lines
are important, and something he, as a Democrat, is used to doing. “I claim the best
legislators are those that have the ability to see when they’ve got to give and work together to
solve problems, rather than just running roughshod with their views over others.”
Senator Brown’s goal this session is to see to that current budget process is as fair as it can
be, while still trying to maintain a quality of life. While his emphasis is on education, health,
and law enforcement issues, he doesn’t want to decimate programs like the State Lake
Improvement Fund, The Heritage Fund, and various recreational programs. “Obviously
these programs must give their fair share in budget cuts, but they do make a major
contribution to our quality of life, which is very important to every Arizonan,” Brown says.
Keeping people in rural Arizona is one of Senator Brown’s greatest challenges; therefore, he
works hard to get both private and government businesses to establish in his district. “Most
of the economic development in my county, and in a lot of the other too, is what nobody else
wants,” Brown said. With that, he means prisons, land fields and power plants. These might
not be the most glamorous jobs, but in Senator Brown’s opinion, at least there will be jobs.
“It’s jobs, it’s economic security. Jobs are what we are after; we just don’t have enough well-paying
jobs to keep our young people at home.”
People are frequently amazed at Senator Brown’s energy and ability to keep up with these
ever changing times. “With 8 grown children and 33 grandchildren, I don’t have much choice
but to stay active and alert. Add to that a wife who has many years of legislative experience
and watches the issues (and my voting record) closely it’s never a dull moment and one I
wouldn’t trade.”

forward, but wants to change the "must" language. Senator Solomon said that she had the same concerns over the language,
but since the experts brought it, she supports the bill. Senator Hellon said that her concerns over the language were stronger
and thus she cannot support the bill. Senator Hartley concurred with Senator Hellon.

"syndrome" is another word for "theory," and that sexualized children are not unhealthy unless forced to be that way. He
added that he had never heard of another syndrome being used or abused in this way. Senator Hartley agreed with Senator
Solomon that prohibiting the court from doing something is not right. Senator Petersen said that, by voting against this bill,
the members are turning a deaf ear to problems that are out there. Senator Hellon also had a problem with prohibiting the
courts, and had to oppose the bill despite the compelling testimony. Senator Hartley respectfully disagreed with Senator
Petersen, even though she has sympathy for the issue.

the no call list requirements to all sellers regardless of registration status; Requires the Secretary of State to prescribe by rule
the procedure for publishing an official no call list on a quarterly basis; Allows the Secretary of State to contract with a

with whom the subscriber has had an established business relationship, so that the relationship: Existed within the preceding
12 months, instead of 180 days and did not exist in a monopoly relationship and the seller is calling in relation to the
relationship or invitation; Modifies the subscriber civil cause of action by allowing two unauthorized phone solicitations
before enforcement, decreasing the recovery of damages from $5000 to $1000 and allowing attorney fees, costs and damages
to be recovered instead of whichever is greater.

Commerce Amendment: Increases the minimum level of the fund from $100,000 to $200,000. Increases the residential recovery
fund maximum payout per license from $100,000 to $200,000. Increases the alternate bond for dual licensed contractors and

Defines information systems security information and requires state agencies to maintain the confidentiality of their
information systems security information.
Government Amendment: ADOPTED
Includes the requirement that investigations must be "pursuant to a court order".
Martin Floor Amendment: ADOPTED
Allows an agency that is responsible for the confidentiality of their information systems security information to share their
information systems security information with the Office of the Auditor General.
SB1336 sales tax; contractor's solar exemption (Yrun) DPA
Creates a transaction privilege tax exemption for prime contractors for the installation of solar energy devices.
Finance Amendment: ADOPTED
Changes the TPT exemption sunset date from January 1, 2003 to December 31, 2003.
SB1393 political subdivisions; military airports; zoning (Hamilton) DPA
Requires school districts to adopt and enforce school district development plans for property in the high noise or accident
potential zone of a military airport. Reduces the size of the high noise or accident potential zone for political subdivisions
located in a county with a population of more than 800,000 persons but less than two million persons.

Exempts the use of irrigation areas not incidental to farming from collection pools.

Makes technical changes.
Hamilton Floor Amendment: ADOPTED
Specifies the time period in which political subdivisions must submit compliance reports and adds an emergency clause.

Extends time limits which the Governor may sign or veto a bill while the Legislature is in session or has adjourned.
Government Amendment: ADOPTED
Reduces the time limits from 15 days to 10 days during session and from 30 days to 20 days after the session has adjourned.
Rios Floor Amendment: ADOPTED
Proposed Constitutional amendment to allow the Legislature to override a veto by the Governor issued after the final adjournment of
the Legislature, within the first four days of the next regular or special session meeting of the Legislature after the veto.
Democratic Caucus
Budget Discussion: Senator Cummiskey remarked that the Democrats had presented three different options in the conference
committee as to where monies should be drawn from to fund the issue of government employee pay raises. He said that the
Democrats did not feel comfortable taking any additional money from the tobacco education fund as the House has suggested.
SB1073 liquor; direct shipment (Daniels)
Senator Valadez had certain objections to this bill. First he believes it skirts around the three-tier system. Second he stated that
although the bill provides for applicable taxes to be charged, they would be paid to the state from which the liquor is bought.
SB1213 home schools; environmental education grants (Burns)
Senator Blanchard expressed concern that the strike everything amendment takes away the power of local school boards to make
decisions regarding the use of their desegregation funds.
SB1124 judicial productivity credits; additional salaries (Jarrett)
Senator Richardson reminded the caucus that the bill was a compilation of suggestions put together by a committee, not a consensus
bill. Senator Rios said that at the end of the day the JP is elected by the community who could determine if they were qualified to
serve. He asked why take opportunities away from young people. In addition he commented that to serve as a Legislator the age
requirement is 25.
SB1335 animal cruelty; increased penalties (Yrun)
Senator Yrun stressed that the decision to treat the action as a felony or misdemeanor is discretionary.
Republican Caucus
Budget Discussion: Senator Bennett updated the members on what went on in the Conference Committee earlier in the day. He
explained to the members no agreement was reached because of a misunderstanding between the House and the Senate regarding the
tobacco education fund and they were unable to come up with a compromise with the Democrats on a solution.
SB1124 judicial productivity credits; additional salaries (Jarrett)
Senator Jarrett said she will be offering a floor amendment to the bill. In addition, she said JP’s get paid for a full week of work,
however, they only work a couple of days a week, and this bill would change that. Senator Hellon was concerned with the tension
between JP’s and judges because JP’s don’t have to have a legal background. Senator Verkamp said that the situation between the JP’s
and the Supreme Court is major issue.
SB1129 early graduation college scholarships (Bundgaard)
Senator Daniels was concerned with the bills fiscal impact. Senator Bundgaard replied that there doesn’t necessarily have to be a fiscal
impact.
SB1179 occupational disease; peace officers (Cirillo)
Senator Daniels said that when a similar bill concerning firefighters was passed there was no evidence presented that the hazardous
materials actually caused cancer. Senator Bennett asked which group of people would be pushing for a similar bill next year. Senator
Smith said he disagreed with the bill because the workers are not exposed to hazardous materials on a daily basis. He added that he
thought it was the Police Department that should take the bill under consideration, not the state.

Senator Jarrett asked what was considered animal cruelty. Senator Smith said he is against the bill since it is too broad.
