STATEMENTOFPURPOSE
In accordance with United States Supreme Court interpretations of the United
States Constitution, the Arizona Legislature is required to redistrict the state
following each decennial census. The purpose of this process is to adjust
congressional and legislative district boundaries to produce districts that provide
equal representation to all.
GUIDELINES
The following guidelines have been established through historical, legal and
judicial precedent for creating a redistricting plan:
1. The Equal Protection Clause of the Fourteenth Amendment
to the United States Constitution requires that legislative
districts be drawn to achieve " substantial equality of
population among various districts". The ideal legislative
district population is 122,174.
2. Each congressional district must be " as nearly equal in
population as practicablet1 in accordance with the
Apportionment Clause of Article I, Section 2 of the United
States Constitution. Any deviation from the ideal
population of 610,871 must be justified by its necessity to
meet a rational state policy.
3. Redistricting plans should not have either the purpose or
the effect of diluting racial minority voting strength and
shall comply with the Voting Rights Act of 1965, as
amended and the 14th and 15th Amendments to the
Constitution of the United States.
4. All legislative and congressional districts should be
reasonably compact.
5. All legislative and congressional districts should be
composed of contiguous geography.
6. Redistricting plans for Arizona are subject to the
preclearance process established in Section 5 of the Voting
Rights Act.

through a series of hearings to be held throughout ther state
during July and August. The hearing sites have been chosen to
ensure that all of those interested in participating in the
process will have the opportunity to do so.

A BRIEF HISTORY OF REDISTRICTING IN ARIZONA
The redistricting process in Arizona since 1964 has been sigmficantly affected
by a number of federal court decisions and by federal legislation. Congressional and
legislative district boundaries must conform to the " one- person one- vote" principle
established by the United States Constitution. In addition, the districts must
conform to the Federal Voting Rights Act, which protects the voting rights of
minorities. Redistricting is the responsibility of the state legislature, although the
validity of the plans developed by the legislature have been challenged in federal
court, and those challenges have significantly affected redistricting in Arizona.
In 1964 a lawsuit was filed in federal district court seeking a declaration that
Arizona's legislative and congressional district boundaries were unconstitutional.
Klahr v. Goddard was stayed by the federal court to allow the legislature sufficient
time to address the issue. By 1966 the legislature had not devised a constitutional
redistricting plan so the federal court approved a legislative and congressional plan
to be used for the approaching elections and until the legislature approved a plan.
In 1967, the legislature approved a redistricting plan, which was approved by
the voters through the referendum process. This plan was challenged in federal
court and, in Klahr v. Williams ( 1969), the court ruled the congressional and
legislative plans unconstitutional for failing to satisfy the " one- person one- vote"
mandate.
In 1970, the legislature again enacted legislative and congressional
redistricting plans which were reviewed by the federal district court. The court
ruled that the plans failed to satisfy federal constitutional requirements. The court
also reviewed the redistricting plan the court had approved in 1966 and concluded
that in Light of recent federal case law regarding the one- person one- vote
requirement the court- approved plan was no longer constitutional. Although the
legislature's plan did not meet constitutional standards, the court allowed the state
to use it for the 1970 elections because it conformed more nearly to constitutional
standards than the earlier court- approved plan. The United States Supreme Court
subsequently affirmed the district court's decision in this case.
Following the 1970 census, the legislature in October 1971 enacted a
reapportionment plan for four congressional districts and thirty legislative districts.
The district court reviewed the plans and required that the Navajo Reservation be
placed in one legislative district. Because of impending elections, the court
approved a modified plan to be used until the legislature adopted a plan. The
legislature subsequently adopted a modified plan.
Following the 1980 census the legislature enacted its plans for congressional
and legislative districts. Under Section 5 of the Federal Voting Rights Act Arizona
is required to submit any changes that affect voting to the United States Department
of Justice or the Federal District Court of the District of Columbia for preclearance
or court approval. The 1980 plans were submitted to the Department of Justice for
preclearance. The plans were also challenged in the federal district court of Arizona
in the case of Goddard v. Babbitt. The legislative plan failed to obtain preclearance
under the Voting Rights Act and the district court subsequently found there was
therefore no valid legislative redistricting plan in existence. The district court
found the congressional redistricting plan unconstitutional because it failed to
achieve the required numerical equality among districts. Before the trial in this case
was completed the parties involved stipulated to modified plans which were then
approved by the district court. These modified plans for congressional and
legislative districts have been used for elections since 1982.
In accordance with Section 5 of the Voting Rights Act, Arizona still may not
implement changes affecting voting rights without prior approval of the District
Court for the District of Colombia or from the United States Attorney General. Any
requests for changes affecting voting rights are to be granted only if the change
contemplated has neither the purpose nor the effect of denying the right to vote on
account of race, color or language minority status. In submitting a plan for prior
approval of the Justice Department, the burden of proof is on the party submitting
the plan. Key factors in this regard are whether the plan dilutes the minority
representation or diminishes access to the political process.
