ACUPUNCTURE BOARD OF EXAMINERS
Background
Pursuant to Arizona Revised Statutes ( A. R. S.) fj 41 - 2953, the Joint Legislative Audit Committee
( JLAC) assigned thc sunset review of the Acupuncture Board of Examiners ( Board) to the Senate
I- lealth and House of Representatives Health Comlnittee of Rcfercncc.
The Board was established in 1998 to regulate the practice of acupuncture. Statute defines
acupuncture as puncturing the skin by thin solid needles to reach subcutaneous structures and
stimulating the needles to affect a positive therapeutic response at a distant site. The Board's duties
include evaluating license and certilicatc applications, issuing licenses and certificates, establishing
fccs, adopting rules, initiating investigations and taking disciplinary actions as necessary.
Pursuant to A. R. S. 5 32- 3905, the State Treasurer collects all nlonies received by the Board and
deposits ten percent of the monies and all civil penalties imposed on licensees into the state General
Fund. The remaining 90 percent of monies received are deposited in the Acupuncture Board of'
Examiners Fund and are used by the Board for all necessary Board cxpcnses.

Board's responses to the sunset factors as required by A. R. S. fj 41- 2954, subsections D and F, and to

The Arizona Acupuncture Board of Examiners ( Board) is scheduled to sunset on July 1,2008.
The following is a brief description of the history and duties of the Board, as well as the Board's
response to the sunset questionnaire. A public meeting is scheduled for November 6,2007, to review,
discuss and make a final recommendation on the Board's continuation. If you have any questions or

BOARD HISTORY AND MISSION
The Board was established in 1998 to regulate the practice of acupuncture. Statute defines
acupuncture as puncturing the skin by thin solid needles to reach subcutaneous structures and
stilnulating the needles to affect a positive therapeutic response at a distant site. Auricular acupuncture
is the application of acupuncture needles to parts of the human ear to treat alcoholism, substance abuse
or chemical dependency.
The mission of the Board is to protect the health, safety and welfare of the citizens of .4rizona by
regulating and maintaining standards of practice for acupuncture.
OliGANlZATlON AND DUTIES
The Board consists of nine members who are appointed by the Governor for three- year terms.
1- our of the Board members must be licensed acupuncturists, three must be public members and two
members must be licensed as either a nledical doctor. an osteopathic doctor, a naturopathic physician, a
homeopathic physician or a chiropractor. The Board appoints an executive director to cany out the
Board's functions and perform administrative duties.
The Board's duties include evaluating license and certificate applications. issuing licenses and
certificates, establishing fees, adopting rules. initiating investigations and taking disciplinary actions as
necessary. The Board estimates that it regulates approximately 450 active acupuncture licensees and
approxin~ ately6 0 certified auricular acupuncturists. In FY 2006- 2007, the Board's average timeframe
for resolving complaints was 76 days. The Board states that additional duties include updating
inforlnation technology requirements, budgeting and addressing public inquiries about acupuncture.
The Board also holds public meetings at least once a month and maintains a website.
The Board issues acupuncture licenses and auricular acupuncturist certifications to qualilied
applicants. A person who applies for a license to practice acupuncture nlust have at least 1,850 hours of

training in a Board- approved program. including at least SO0 hours of Board- approved clinical training.
An applicant must also be certified by the National Certification Commission for Acupuncture and
Oriental Medicine ( NCCAOM) or must have been licensed by another state with substantially similar
standards and must not have had a license or certificate revoked. An applicant for an auricular
acupuncture certificate must successfully complete a Board- approved training program in acupuncture
for the treatment of alcoholism, substance abuse or chemical dependency that meets or exceeds the
standards of the National Acupuncture Detoxification Association. An applicant must also complete a
clean needle technique course approved by the Board.
The Board does not identify any other agencies that duplicate or conflict with the Board. As
such, the Board believes that the elimination of the Board would put the public in danger of receiving
acupuncture treatment from incompetent and unethical practitioners. '
FISCAL ISSUES
The Board's total operating budget for FY 2007- 2008 is $ 1 25,500. The Board cun- ently has one
full- time equivalent ( FTE) position. Pursuant to A. R. S. § 32- 3905, the State Treasurer collects all
monies received by the Board and deposits ten percent of the monies and all civil penalties imposed on
licensees into the state General Fund. The remaining 90 percent of monies received are deposited in the
Acupuncture Board of Examiners Fund and are used by the Board for all necessary Board expenses.

not indicate any requests for legislative changes.

This letter is in response to your call for comment of September 25, 2007, regarding the sunset review of the Arizona
Acupuncture Board of Examiners this year. The Council of Colleges of Acupuncture and Oriental Medicine, the nonprofit
membership associat~ onfo r acupuncture and Oriental ( AOM) medicine colleges in the U. S., strongly urges the state legislature to
continue the Board in existence.
The Council, which was established in 1982, represents some 53 AOM colleges and programs, all of which have achieved
either full accred~ tationo r pre- accreditation ( candidacy) status with the Accreditation Commission for Acupuncture and Oriental
Medicine ( ACAOM), which is the official U. S. Department of Education recognized accrediting agency for AOM programs in the
U. S. The mission of the Council is to advance AOM by promoting educational excellence in the field. Currently, there are three
AOM colleges in Arizona that are also members of the Council: Arizona School of Acupuncture and Oriental Medicine ( Tucson),
Asian Institute of Medical Studies ( Tucson), and Phoenix Institute of Herbal Medicine and Acupuncture ( Phoenix).
The continuation of the Arizona Acupuncture Board of Examiners is important in order to ensure the health and safety of
citizens of Arizona. Acupuncture is currently regulated by statute in 42 states and the District of Columbia. Where acupuncture is
regulated by an independent board, as is the case in Arizona, such boards perform the vital function of screening applicants for
licensure by ensuring that they meet appropriate standards of education and training, and that they retain those standards through
continuing education. These boards also play an important role in disciplining licensees who engage in misconduct and in taking
appropriate administrative action against unlicensed persons who practice unlawfully in the state.
The practice of AOM is safe only when employed by trained and competent persons. With the common use of disposable
needles, the risk of infection by the use of unsterilized needles has markedly decreased in recent years, but there is still risk of
accidental injury involving the puncture of an internal organ ( such as a lung) if acupuncture is used by untrained persons. The
contemporary trend toward incorporating acupuncture practice into integrated health care settings ~ nvolvingc onventional medical
practit~ onerss, uch as multidisciplinary clinics or hospitals, only reinforces the need for oversight by the Board to ensure that
standards of practice remain high.
With the increasing popularity of complementary and alternative ( CAM) means of care among health care consumers, the
need for clarity within each state of the qualifications and credentials of CAM practitioners, such as acupuncturists, is
underscored. The Board, by virtue of its expertise and administrative mandate, provides an authoritative focal point of clarity for
Ar~ zona'sh ealth care consumers through the Board's ability to verify that practitioners have met applicable standards and are
authorized to practice.

I am writing in my capacity as the Associate Deputy Director of the National Certification
Commission for Acupuncture and Oriental Medicine ( NCCAOM), to comment on the
performance of the Acupuncture Board of Examiners. We believe that the Acupuncture
Board of Examiners serves the public well and should continue its functions.
NCCAOM is a non- profit organization established in 1982. Its mission is to establish,
assess, and promote recognized standards of competence and safety in acupuncture
and Oriental medicine for the protection and benefit of the public. NCCAOM Certification
indicates to employers, patients, and peers that one has met national standards for the
safe and competent practice of acupuncture as defined by the profession. NCCAOM's
certification programs are accredited by the National Commission for Certifying Agencies
( NCCA) of the National Organization for Competency Assurance ( NOCA).
As of today, forty of the forty- one states that regulate the practice of acupuncture
recognize NCCAOM examinations for licensure purposes. This along with our mission in
protecting public safety makes us partners with the states. Over the years, we have
worked closely with the Acupuncture Board of Examiners to exchange information
confirming that licensure applicants meet national standards. In addition, we have
reported disciplinary actions to the Arizona Board. This activity is extremely important in
that it protects the citizens of AZ and of other states in cases where licensees have been
disciplined for unsafe practice in one state and attempt to practice in another state. Our
experience with the Executive Director and the Board itself has been positive in
confirming that those who should be licensed and/ or certified are safe and discipline- free
practitioners. We believe that the fact that this Board exists works as a deterrent to
unsafe practice by licensees in your state. Practitioners are aware that the Board will
take action and that information will be made public.

Dclla Estrada, Arizona Acupuncture Board of Examiners, explained that the Board provides
regulatory oversight of the almost 450 active licensed acupuncturists in Arizona and has
successfully accomplished its mandate to ensure the safety of the general public
( Attachment 12).

Janet Midlciff, Arizona State Dental Hygienists' Association, stated that they support the concept
of trailling community people to be dental healtli representatives, and that the definition of the
COHR does make sense to them. She stated concerns about the education, licensing, or
certification of the people who fill the COHR positions. She said that her organization would
like to work with the ADA and to be a part of thc access to care issue.
Nicole Albo, Arizona Dental Assistants' Association, stated her support for the COIHR program
provided that the positions will be filled by certified dental assistants with additional training
components. She stated that she has been working with the ADA to develop a curriculum for
expanded COIIK training.
Representative Murphy asked if the committee could approve the concept but not specify the
details, letting the Legislative process do that. Mr. Murray stated that the supervision issue is the
biggest concern.

the COI- IR but is neutral on the application at this time due to concerns about supervision and
scope of practice.
