He moved to Prescott and began practicing law there until 1883, when he served as assistant US district attorney in Yavapai County. In 1886, he was elected district attorney of Yavapai County and again served the position in 1891 after the death of Robert Brown.
He was the Arizona delegate to the Democratic National Convention in St. Louis in 1890 and a member of the Territorial Council. He served as the Attorney General of Arizona Territory in 1893. In 1899, he was a member of the Code Commission.
He is the father of Charles W. Herndon, a member of the Arizona Senate from the 1920s. John passed away in Prescott on May 10, 1906 after a lingering illness.
